WHEREAS section 56.2 of the Act respecting municipal courts (R.S.Q., c. C-72.01) provides that a majority of the municipal judges, in agreement with the chief judge, may adopt uniform rules of practice applicable to all municipal courts in matters necessary for the exercise of their jurisdiction, either at a meeting called for that purpose by the chief judge or through any other means whereby the chief judge may consult them, that the rules of practice must be compatible with the provisions of the Act respecting municipal courts and the provisions of the Code of Civil Procedure (R.S.Q., c. C-25) and the Code of Penal Procedure (R.S.Q., c. C-25.1), that the rules of practice are subject to the approval of the Government and that the provisions of the Regulations Act (R.S.Q., c. R-18.1), except sections 21 to 24, apply to the rules;
ATTENDU QUE l’article 56.2 de la Loi sur les cours municipales (L.R.Q., c. C-72.01) prévoit que la majorité des juges municipaux peuvent, soit à une assemblée convoquée à cette fin par le juge en chef, soit par tout autre mode permettant à celui-ci de les consulter, adopter, de concert avec le juge en chef, des règles de pratique communes à toutes les cours municipales, dans les matières nécessaires à l’exercice de leur compétence, que ces règles doivent être compatibles avec les dispositions de la Loi sur les cours municipales et avec celles du Code de procédure civile (L.R.Q., c. C-25) et du Code de procédure pénale (L.R.Q., c. C-25.1), qu’elles sont soumises à l’approbation du gouvernement et que les dispositions de la Loi sur les règlements (L.R.Q., c. WHEREAS section 24.1 of that Act provides that the associate chief judge of the Court of Québec who is responsible for municipal courts shall exercise, under the authority of the chief judge of the Court of Québec, the functions exercised by the chief judge in respect of municipal judges and municipal courts pursuant to the Act respecting municipal courts, in addition to the functions assigned to the associate chief judge by the Courts of Justice Act (R.S.Q., c. T-16);

I. whereas the Venice Commission, in its most recent report on the rule of law, listed six elements on which there was consensus and which constitute the basic pillars of the rule of law: legality, including a transparent, accountable and democratic process for enacting law; legal certainty; the prohibition of arbitrariness; access to justice before independent and impartial courts, including the judicial review of administrative acts; respect for human rights; and non-discrimination and equality before the law;

4. Calls on the Council and EU Members States to act respectively at the next CCW 4th Review Conference in Geneva from 14–25 November 2011;

Calls on the EU Member States not to take any action that might circumvent or jeopardise the CCM and its provisions; in particular, calls on all EU Member States not to adopt, endorse or subsequently consent to be bound by a possible Convention on Conventional Weapons (CCW) protocol allowing for the use of cluster munitions which would not be compatible with the prohibition of such munitions pursuant to Articles 1 and 2 of the CCM; calls on the Council and EU Members States to act respectively at the next CCW meeting on 30 August - 3 September 2010 in Geneva;
