1. Unless otherwise provided for in the implementing Regulation, where a person is eligible for a benefit, or is liable to pay a contribution in accordance with the basic Regulation, and the competent institution does not have all the information concerning the situation in another Member State which is necessary to calculate definitively the amount of that benefit or contribution, that institution shall, on request of the person concerned, award this benefit or calculate this contribution on a provisional basis, if such a calculation is possible on the basis of the information at the disposal of that institution.

This Regulation lays down rules specifying the conditions for implementing of the obligation of the Single Resolution Board (‘the Board’) to calculate the contributions for individual institutions pursuant to Regulation (EU) No 806/2014 to the Single Resolution Fund (‘the Fund’) and the methodology for the calculation of those contributions.
Le présent règlement établit des règles précisant les conditions de mise en œuvre de l'obligation qui incombe au Conseil de résolution unique (CRU) de calculer la contribution de chaque établissement au Fonds de résolution unique (ci-après dénommé le «Fonds») conformément au règlement (UE) no 806/2014 et la méthode de calcul de ladite contribution.

Accordingly, the calculation of contributions to be allocated to the mutualised part should rely on the criteria laid down in Regulation (EU) No 806/2014, whereas, by derogation from the period of time provided for by Article 102(1) of Directive 2014/59/EU, the calculation of contributions to be allocated to the non-mutualised part of compartments should rely on the criteria laid down in Directive 2014/59/EU and on the basis of a target level defined over a period of time corresponding to the initial period set out in Regulation (EU) No 806/2014.

By way of derogation from the rule that the calculation of contributions should be performed at individual level, in the case of a central body with credit institutions affiliated to it that are wholly or partially exempted from prudential requirements in national law in accordance with Article 10 of Regulation (EU) No 575/2013 of the European Parliament and of the Council, the rules on ex ante contributions should only apply to the central body and the affiliated credit institutions as a whole on a consolidated basis because the solvency and liquidity of the central body and of all the affiliated institutions are monitored as a whole on the basis of consolidated accounts of these institutions.
Par dérogation à la règle prévoyant que les contributions doivent être calculées au niveau individuel, dans le cas d'un organisme central dont les établissements de crédit affiliés sont totalement ou partiellement exemptés des exigences prudentielles dans le droit national sur la base de l'article 10 du règlement (UE) no 575/2013 du Parlement européen et du Conseil, les règles concernant les contributions ex ante ne doivent s'appliquer que sur une base consolidée à l'organisme central et à ses établissements de crédit affiliés dans leur ensemble, puisque la solvabilité et la liquidité de l'organisme central et de tous les établissements affiliés sont suivies dans leur ensemble sur la base des comptes consolidés de ces établissements.

2. A CCP shall establish the minimum size of contributions to the default fund and the criteria to calculate the contributions of the single clearing members.
