With regard to the claims for the Tribunal, first, to order the applicant’s post to be regraded to a grade corresponding to the level of his responsibilities and, secondly, to order the EEAS to bear all the consequences, in particular the financial consequences, of that regrading, retrospectively from the time of his entry into the service, it should be noted that, in the context of an action brought under Article 91 of the Staff Regulations, the court may not, without encroaching upon the powers of the administration, make declarations or findings of principle, or issue directions to an institution (see order in Caminiti v Commission, F‑71/09, EU:F:2011:53, paragraph 23 and the case-law cited therein).

In that regard, the applicant claims that, by virtue of the principle and provisions cited above, when the OIE recognised certain Member States of the European Union — Italy included — as countries with a negligible BSE risk (namely, May 2008, May 2011, May 2012 and May 2013), the Commission was required to update its legislation in the light of that new information and to review the derogation provided for in point 2 of Annex V to Regulation No 999/2001 in order to ensure observance of the principle of non-discrimination: first, the derogation in question treats differently similar situations: that of producers in Member States and that of producers in third countries which have been recognised as countries with a negligible BSE risk.
À cet égard, il est soutenu qu’en vertu dudit principe et des dispositions précitées, dès lors que l’OIE a reconnu en mai 2008, en mai 2011, en mai 2012 et en mai 2013 que certains États membres, dont l’Italie, pouvaient être qualifiés comme étant des pays présentant un risque d’ESB négligeable, la Commission était tenue d’adapter la réglementation au regard de ces nouvelles données et de réexaminer la dérogation à cet effet de l’annexe V, point 2, du règlement afin de garantir le respect du principe de non-discrimination. In that regard, the applicant claims that, by virtue of the principle and provisions cited above, following the OIE’s recognition of certain Member States of the European Union as countries with a negligible BSE risk, the Commission was under an obligation to update its legislation in the light of that new information and to review the temporary derogation provided for in point 2 of Annex V to Regulation No 999/2001 in order to ensure observance of the principle of proportionality.

As may be seen from the case-law, the principle of equality of treatment must be reconciled with the principle of legality, according to which no person may rely, in support of his claim, on an unlawful act committed in favour of another (judgments in Cases 188/83 Witte v Parliament [1984] ECR 3465, paragraph 15, 134/84 Williams v Court of Auditors [1985] ECR 2225, paragraph 14, and Italy v Council , cited in paragraph 134 above, at paragraphs 87-93).

In that regard, the Court recalls that the principle of proportionality, which is one of the general principles of Community law, requires that measures adopted by Community institutions do not exceed the limits of what is appropriate and necessary in order to attain the legitimate objectives pursued by the legislation in question; when there is a choice between several appropriate measures recourse must be had to the least onerous, and the disadvantages caused must not be disproportionate to the aims pursued (see the judgment in Case C‑41/03 P Rica Foods v Commission [2005] ECR I‑6875, paragraph 85, and the case-law cited).
