Bearing in mind the large concentration of European seafarers in the intra-Community maritime transport services and thus the need to promote employment and prevent potential shortages in this field, the services of the Commission launched a widespread study to further consider this sector .

This article shall apply to the provision of air transport services when the flight departs from an airport in the territory of a Member State to which the Treaty applies, from an airport located in a third country, bound for an airport on the territory of a Member State if a Community air carriage contractor is involved, or from an airport located in a third country, bound for another third country if the flight is part of a journey which started in the Community, provided the air carriage contractor has an establishment in the Community, the contract was concluded within the Community or the passenger's normal place of residence is within the Community.

The EC Treaty contains special transport provisions conferring on the Community specific powers which allowed it to adopt three "packages" of regulations (in 1987, 1990 and 1992) designed to ensure freedom to provide Community air transport services and free competition within the Community.
