It cannot be accepted that any decision of the administration, whether explicit or implied, containing either an inadequate statement of reasons or no statement of reasons (and thus necessitating a substantive examination) would be liable at any moment to become the subject of a request for an additional statement of reasons enabling officials or staff members to set themselves a new time-limit for lodging a complaint by claiming that they have three months from the receipt of that additional statement of reasons to lodge that complaint, even though the fact that a decision as referred to in Article 90(1) of the Staff Regulations contains an inadequate statement of reasons may — indeed must — be raised specifically in a complaint and thus be duly rectified, where necessary, by the administration in the decision ruling on that complaint.

In the context of respect for the right to effective judicial protection, it is none the less important to specify that, in a situation where the complainant becomes aware of the statement of reasons for the act adversely affecting him by way of the response to his complaint or in a situation where that statement of reasons modifies or supplements substantially the statement of reasons contained in that act, any plea put forward for the first time at the application stage which aims to dispute the merits of the reasons set out in the response to the complaint must be deemed to be admissible. In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission relating to requirements, display and warning functions and type-approval of tachographs, as well as to detailed provisions for smart tachographs; the procedures to be followed for carrying out field tests and the forms to be used in order to monitor those field tests; the standard form for the written statement giving reasons for seal removal; the common procedures and specifications necessary for the interconnection of electronic registers; and the methodology specifying the content of the initial and continuing training of control officers.

In particular, the applicant states that the Commission: (a) failed to seek and/or obtain the underlying evidence for the allegations; (b) failed to ensure the statement of reasons was coterminous with the reason relied upon by the United Nations Sanctions Committee and failed to seek and/or obtain sufficient detail of the allegations such as to permit the applicant to answer such effectively; (c) failed to assess whether any of the allegations are based upon material tainted by torture; and (d) failed to seek and/or obtain any relevant exculpatory material.

The applicant claims that the statement of reasons mentioned in the contested regulation is merely a standard statement of reasons which does not make it possible to follow the reasoning of the Commission, whereas the Commission should have indicated very specifically the considerations justifying moving from a refund of EUR 108,50 per tonne to EUR 0, particularly because it is breaking from its previous decision-making practice.

Lastly, it is not possible for the applicant to rely on the judgment of 14 October 2008 in Meierhofer v Commission (Case F-74/07, set aside on appeal – but not as regards the finding that the statement of reasons for the decision was inadequate – by judgment of 12 May 2010 in Case T-560/08 P Commission v Meierhofer), in which the General Court annulled, on the ground that its statement of reasons was inadequate, the selection board’s decision not to include the applicant on the reserve list, since the Commission had refused to produce, in addition to the individual eliminatory mark received by the applicant in the oral test, further details such as the intermediate marks used to calculate that mark and, where appropriate, the evaluation sheets.
