The agreement aims to ensure that adequate rules on the protection of intellectual property are applied in all member countries, on the basis of the basic obligations laid down by the World Intellectual Property Organisation (WIPO) in the various conventions on intellectual property rights (the Paris Convention for the Protection of Industrial Property, the Berne Convention for the Protection of Literary and Artistic Works, the Rome Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organisations, and the Washington Treaty on Intellectual Property in Respect of Integrated Circuits).

Recalls that the EU has ratified the 2005 UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions and calls on the Member States who have not already done so to ratify the 1970 Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property, and the 1950 UNIDROIT Convention on Stolen and Illegally Exported Cultural Objects, which represent important tools for strengthening the protection of global cultural heritage and cultural diversity, as well as the 1954 Convention for the Protection of Cultural Property in the Event of Armed Conflict and its two protocols, the 2001 UNESCO Convention on the Protection of the Underwater Cultural Heritage and the 2003 UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage; calls for the harmonisation of legislation and an international agreement on cultural heritage and illicit trafficking;

J. whereas in March 2012 UNESCO urged the Syrian authorities to ‘respect the international Conventions they have signed, in particular the 1954 Convention for the Protection of Cultural Properties in the Event of Armed Conflict, the Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property (1970), and the 1972 World Heritage Convention’, thus recalling their duty to ensure the protection of the cultural heritage;

Welcomes the work of the inter-sessional open-ended working group of the UNCHR in charge of preparing a draft legally binding normative instrument for the protection of all persons from enforced disappearance; and supports the drafting of a convention on protection and assistance for victims of terrorist attacks; calls on the UNCHR to adopt, as a matter of priority, a draft convention on the protection of all persons from enforced disappearance; and urges the Council and all governments of Member States to support both working groups, with a view to early adoption of the convention by the General Assembly of the United Nations;

11.
