Where the Court of Justice is seised of a case in which the same issue of interpretation is raised, or where the Court First Instance is seised of a case in which the validity of the same Community patent is called in question, the Community Patent Court may, after hearing the parties, stay proceedings before it until such time as the Court of Justice or the Court of First Instance shall have delivered judgment.
Lorsque la Cour de justice est saisie d'une affaire soulevant la même question d'interprétation ou lorsque le Tribunal de première instance est saisi d'une affaire mettant en cause la validité du même brevet communautaire, le Tribunal du brevet communautaire peut, après avoir entendu les parties, suspendre la procédure jusqu'au prononcé de l'arrêt de la Cour de justice ou du Tribunal de première instance.

With regard to its structure, the present Decision contains three chapters relating to the Community Patent Court (Chapter I), the appeal proceedings against decisions of the Community Patent Court before the Court First Instance (Chapter II) and final provisions (Chapter III).

Unlike the judges of the Court of Justice and the Court First Instance who are appointed by common accord of the governments of the Member States, the judges of a judicial panel are appointed by a unanimous decision of the Council.

26 While it is true that the Statute of the Court of Justice and the Rules of Procedure of the Court of First Instance provide for the possibility of rectifying an application which does not comply with certain procedural requirements, it is also true that, on any view of the matter, non-compliance with the mandatory condition of representation by a lawyer authorised to practise before a court of a Member State or of another State which is a party to the EEA Agreement is not one of the requirements which can be rectified after expiry of the time-limit for bringing an action, in accordance with the second paragraph of Article 21 of the Statute of the Court of Justice and Article 44(6) of the Rules of Procedure of the Court of First Instance.

1. Neither Article 64 of the Rules of Procedure of the Court of First Instance nor Article 24 of the Statute of the Court of Justice, also applicable to the Court of First Instance pursuant to the first paragraph of Article 53 of that Statute, nor any other provision of the Rules of Procedure of the Court of First Instance and of the Statute of the Court of Justice, place any obligation on the Court of First Instance to advise the party lodging an action that his application is inadmissible when it has not been signed by a lawyer authorised to appear before the Community courts.

Pursuant to those provisions and to Article 7(1) of the Rules of Procedure of the Court of First Instance, the Members of the Court have today re-elected Mr Bo Vesterdorf as President of the Court of First Instance.

The number of cases brought to a close was 494 by the Court of Justice and 339 by the Court of First Instance (in 2002, 513 and 331 respectively); an appreciable increase in the number of new cases lodged may be observed, that is to say there were 561 new cases for the Court of Justice and 466 for the Court of First Instance (in 2002, 477 and 411 respectively).

On 19 July 1999 the Court of First Instance annulled the Council's decision, on the ground that the Council should have considered the possibility of partial access to documents. The Council, supported by Spain, has appealed against the judgment of the Court of First Instance.
