In this context, the Council recalls that all EU Member States are party to the Montreal Convention for the Suppression of Unlawful Acts against the safety of Civilian Aviation, which makes it an offence to endanger the safety of an aircraft in flight and requires states that have custody of offenders either to extradite the offender or submit the case for prosecution.

The proposed provision would ensure that no person could engage in any behaviour that endangers the safety or security of an aircraft in flight or of persons on board an aircraft in flight by intentionally doing one of the following: interfering with the performance of the duties of a crew member, lessening the ability of any crew member to perform that crew member's duties, or interfering with any person who was following the instructions of a crew member.
