In November 2012, the United Kingdom updated its previous formal objection made in December 2010 in respect of standard EN 12635:2002+A1:2008 ‘Industrial, commercial and garage doors and gates — Installation and use’ by adding EN 13241-1:2003+A1:2011 ‘Industrial, commercial and garage doors and gates — Product standard — Part 1: Products without fire resistance or smoke control characteristics’ proposed by the European Committee for Standardization (CEN) to be harmonized under Directive 2006/42/EC and which was first published in the Official Journal of the European Union on 18 November 2011 (3).

The Committee considers it essential to have an integrated European policy for the security industry, underpinned by a coordinated approach to tackling the challenges of the industry, a common strategy and a shared vision of its competitive development, in a unified European market.

Whereas these essential requirements provide the basis for the preparation of harmonized standards at European level for construction products; whereas, in order to achieve the greatest possible advantage for a single internal market,to afford access to that market for as many mannifacturers as possible, to ensure the greatest possible degree of market transparency and to create the conditions for a harmonized system of general rules in the construction industry, harmonized standards should be established as far as, and as quickly as, possible; whereas these standards are drawn up by private bodies and must remain non-mandatory texts; whereas, for that purpose, the European Committee for Standardization (CEN) and the European Committee for Electrotechnical Standardization (Cenelec) are recognized as the competent bodies for the adoption of harmonized standards in accordance with the general guidelines for cooperation between the Commission and those two bodies signed on 13 November 1984; whereas, for the purposes of this Directive, a harmonized standard is a technical specification (European standard or harmonized document) adopted by one or both of those bodies upon a mandate given by the Commission in accordance with the provisions of Council Directive 83/189/EEC of 28 March 1983 laying down a procedure for the provision of information in the field of technical standards and regulations (5);
considérant que ces exigences essentielles fournissent la base pour la mise au point de normes harmonisées au niveau européen en matière de produits de construction; que, pour apporter une contribution majeure à un marché intérieur unique, permettre au plus grand nombre possible de fabricants d'accéder à ce marché, assurer à celui-ci le maximum de transparence et créer les conditioias d'un régime général harmonisé européen en matière de construction, il importe d'instaurer, dans toute la mesure du possible et au plus vite, des normes harmonisées; que ces normes sont établies par des organismes privés et doivent rester des textes non contraignants; que, à cet effet, le comité européen de normalisation (CEN) et le comité européen de normalisation électrotechnique (CENELEC) sont reconnus comme étant les organismes compétents pour adopter des normes harmonisées, conformément aux orientations générales concernant la coopération entre la Commission et ces deux organismes, signées le 13 novembre 1984: que, aux fins de la présente directive, on entend par norme harmonisée une spécification technique (norme européenne ou document harmonisé) adoptée par l'un de ces organismes ou par les deux, sur mandat de la Commission, conformément á la directive 83/189/CEE du Conseil, du 28 mars 1983, prévoyant une procédure d'information dans le domaine des normes et réglementations techniques (5);
