CONSIDERING the firm commitment of the Community and its Member States and the Republic of Tajikistan to the full implementation of all principles and provisions contained in the Final Act of the Conference on Security and Cooperation in Europe (CSCE), the Concluding Documents of the Madrid and Vienna Follow-Up Meetings, the Document of the CSCE Bonn Conference on Economic Cooperation, the Charter of Paris for a New Europe and the CSCE Helsinki Document 1992 ‘The Challenges of Change’, and other fundamental documents of the OSCE,
CONSIDÉRANT que la Communauté, ses États membres et la République du Tadjikistan se sont fermement engagés à mettre intégralement en œuvre toutes les dispositions et tous les principes contenus dans l'acte final de la Conférence sur la sécurité et la coopération en Europe (CSCE), dans les documents de clôture des conférences de suivi de Madrid et de Vienne, dans le document de la conférence CSCE de Bonn sur la coopération économique, dans la charte de Paris pour une nouvelle Europe et dans le document «Les défis du changement» de la CSCE d'Helsinki de 1992, ainsi que d'autres documents fondamentaux de l'OSCE.

The Community Patent Court would thus have jurisdiction for the subject matter laid down in Article 1 of the Commission proposal for such a Council Decision, namely for disputes relating to the infringement or the validity of a Community patent and a Community supplementary protection certificate, the use of the invention after the publication of the Community patent application, the right based on prior use of the invention, interim and evidence-protection measures in the subject matters conferred, damages and compensation incurred in the situations referred to above and orders of a penalty payment in case of non-compliance with a decision or order constituting an obligation to act or to abstain from an act.

On the second aspect, it should be noted that, as the honourable Member points out, the granting of nationality of a Member State is a matter of national jurisdiction (see Declaration 2 on nationality of a Member State, annexed to the Final Act of the Conference of the Representatives of the Governments of the Member States establishing the Treaty on European Union, OJ 1992, C 191, page 98). Nonetheless, exercise of this jurisdiction must comply with Community law (see: Judgement of the Court of Justice of 7 July 1992 in case C-369/90, Micheletti, European Court Reports 1992 page I-4239, item 10: “Under international law, it is for each Member State, having due regard to Community law, to lay down the conditions for the acquisition and loss of nationality”. )
En ce qui concerne le second volet, il est à noter que, comme justement le souligne l’honorable parlementaire, l’attribution de la nationalité d’un Etat membre relève de la compétence nationale (voir déclaration n° 2, relative à la nationalité d’un Etat membre, annexée à l’acte final de la conférence des représentants des gouvernements des Etats membres arrêtant le traité sur l’Union européenne, JO 1992, C 191, page 98) ; toutefois, cette compétence doit s’exercer dans le respect du droit communautaire (voir arrêt de la Cour de justice du 7 juillet 1992 dans l’affaire C-369/90, Micheletti, Recueil 1992, page I-4239, point 10 : "La définition des conditions d’acquisition et de perte de nationalité relève, conformément au droit international, de la compétence de chaque Etat membre, compétence qui doit être exercée dans le respect du droit communautaire (.)".

Recalls that, in accordance with the Foto-Frost judgment of the ECJ, national courts do not have the power to declare the acts of the Community institutions invalid, and reaffirms the view that jurisdiction concerning the binding nature of Community law rests solely with the ECJ and draws attention also to the exclusive competence of the European Court of Justice under Articles 164-188 and 219 of the EC Treaty, to have the final say on the scope of the tasks and powers conferred upon the Community institutions;
7 rappelle que, selon la jurisprudence Foto-Frost de la Cour de justice, les juridictions nationales n'ont pas compétence pour déclarer nuls les actes des institutions communautaires et réaffirme que la Cour de justice est seule compétente pour juger du caractère contraignant du droit communautaire; souligne les pouvoirs exclusifs conférés à la Cour de justice européenne, tels qu'ils dérivent des articles 164-188 et 219 du traité CE, de décider en dernier recours de la portée des droits et obligations transférés aux organes communautaires;
