For the application of point (d) of Article 3(4) of Directive (EU) 2015/849 of the European Parliament and of the Council , the reference to serious fraud affecting the Union's financial interests as defined in Article 1(1) and Article2(1) of the Convention should be construed as fraud affecting the Union's financial interests as defined in Article 3 and in Article 7(3) of this Directive or, as regards offences against the common VAT system, as defined in Article 2(2) of this Directive.
Aux fins de l'application de l'article 3, paragraphe 4, point d), de la directive (UE) 2015/849 du Parlement européen et du Conseil , la référence aux cas de fraude grave portant atteinte aux intérêts financiers de l'Union au sens de l'article 1er, paragraphe 1, et de l'article 2, paragraphe 1, de la convention doit s'entendre comme visant les fraudes portant atteinte aux intérêts financiers de l'Union au sens de l'article 3 et de l'article 7, paragraphe 3, de la présente directive, ou, pour les infractions contre le système commun de TVA, au sens de l'article 2, paragraphe 2, de la présente directive.

The Convention drawn up on the basis of Article K.3 of the Treaty on European Union, on the protection of the European Communities' financial interests of 26 July 1995 , including the Protocols thereto of 27 September 1996 , of 29 November 1996 and of 19 June 1997 (the ‘Convention’) establishes minimum rules relating to the definition of criminal offences and sanctions in the area of fraud affecting the Union's financial interests.
La convention, établie sur la base de l'article K.3 du traité sur l'Union européenne, relative à la protection des intérêts financiers des Communautés européennes du 26 juillet 1995 , y compris ses protocoles des 27 septembre 1996 , 29 novembre 1996 et 19 juin 1997 (ci-après dénommée «convention»), établit des règles minimales concernant la définition des infractions pénales et des sanctions en matière de fraude portant atteinte aux intérêts financiers de l'Union.

2. For the purposes of this Directive, the following shall be regarded as fraud affecting the Union's financial interests:

fraud affecting the Union's financial interests, where it is at least serious, as defined in Article 1(1) and Article 2(1) of the Convention on the protection of the European Communities' financial interests (28);

(d) fraud affecting the Union's financial interests, at least serious, as defined in Article 1(1) and Article 2 of the Convention on the Protection of the European Communities' Financial Interests[42];

In cases of fraud, corruption or any other illegal activity affecting the Union's financial interests which are not yet subject to a final judgment, the contracting authority and the panel should be given the possibility to defer the opportunity given to the economic operator to submit its observations.
En cas de fraude, de corruption ou de toute autre activité illégale portant atteinte aux intérêts financiers de l'Union qui ne fait pas encore l'objet d'un jugement définitif, il convient que le pouvoir adjudicateur et l'instance puissent différer la possibilité accordée à l'opérateur économique de soumettre ses observations.

2. The European Anti-Fraud Office (OLAF) may carry out investigations, including on-the-spot checks and inspections, in accordance with the provisions and procedures laid down in Council Regulation (Euratom, EC) No 2185/96 (13) and Regulation (EU, Euratom) No 883/2013 of the European Parliament and of the Council (14), with a view to establishing whether there has been fraud, corruption or any other illegal activity affecting the Union’s financial interests in connection with an agreement, decision or contract funded under this Regulation.
2. L’Office européen de lutte antifraude (OLAF) peut mener des enquêtes, y compris des contrôles et vérifications sur place, conformément aux dispositions et procédures prévues par le règlement (Euratom, CE) no 2185/96 du Conseil (13) et par le règlement (UE, Euratom) no 883/2013 du Parlement européen et du Conseil (14), en vue d’établir l’existence éventuelle d’une fraude, d’un acte de corruption ou de toute autre activité illégale portant atteinte aux intérêts financiers de l’Union, en rapport avec une convention ou une décision ou un contrat financé au titre du présent règlement.

Whereas, for the purposes of achieving the objectives of the Union, the Member States regard the combating of fraud affecting the European Communities' financial interests as a matter of common interest coming under the cooperating provided for in Title VI of the Treaty;
considérant que, aux fins de la réalisation des objectifs de l'Union européenne, les États membres considèrent la lutte contre la fraude portant atteinte aux intérêts financiers des Communautés européennes comme une question d'intérêt commun qui relève de la coopération instituée par le titre VI du traité;
