1. Where, following the procedure provided for in Subsection 1, the Commission finds that the marketing authorisation holder has committed, intentionally or negligently, an infringement as referred to in Article 1, it may adopt a decision imposing a fine not exceeding 5 % of the holder’s Community turnover in the preceding business year.

Lorsque, à l’issue de la procédure prévue à la sous-section 1, la Commission parvient à la conclusion que le titulaire de l'autorisation de mise sur le marché a commis, de propos délibéré ou par négligence, une infraction visée à l'article 1er, elle peut décider d’infliger une amende n'excédant pas 5 % du chiffre d'affaires réalisé par le titulaire dans la Communauté au cours de l’exercice précédent.

This Regulation lays down rules concerning the application of financial penalties to the holders of marketing authorisations, granted under Regulation (EC) No 726/2004, in respect of infringements of the following obligations, in cases where the infringement concerned may have significant public health implications in the Community, or where it has a Community dimension by taking place or having its effects in more than one Member State, or where interests of the Community are involved:
Le présent règlement fixe des règles pour l’application de sanctions financières aux titulaires d’autorisations de mise sur le marché octroyées en vertu du règlement (CE) no 726/2004 en ce qui concerne les infractions aux obligations suivantes, lorsque l'infraction concernée peut avoir d'importantes conséquences pour la santé publique au niveau de la Communauté, lorsqu’elle revêt une dimension communautaire parce qu’elle a lieu ou déploie ses effets dans plus d’un État membre, ou lorsque les intérêts communautaires sont en jeu:

(7) For greater certainty, an individual who undertakes to communicate with a public office holder as described in paragraph (1)(a) is not required to file more than one return under subsection (1) with respect to the undertaking, even though the individual, in connection with that undertaking, communicates with more than one public office holder or communicates with one or more public office holders on more than one occasion.

The position would be different, however, in a situation where the hyperlink permits users of the site on which that link appears to circumvent restrictions put in place by the site on which the protected work appears in order to restrict public access to that work to the latter site’s subscribers only, since in that situation, the users would not have been taken into account as potential public by the copyright holders when they authorised the initial communication.
Il en irait toutefois autrement dans l’hypothèse où un hyperlien permettrait aux utilisateurs du site sur lequel ce lien se trouve de contourner des mesures de restriction prises par le site où se trouve l’œuvre protégée afin d’en restreindre l’accès par le public à ses seuls abonnés, puisque dans cette hypothèse lesdits utilisateurs n’auraient pas été pris en compte comme public potentiel par les titulaires du droit d’auteur lorsqu’ils ont autorisé la communication initiale.

2. The competent authority of the Member State, where satisfied that the prospective applicant intends to apply for an authorisation, or the renewal or review thereof, shall provide him with the name and address of the holder or holders of previous relevant authorisations and shall at the same time inform the holders of the authorisations of the name and address of the applicant.

Si l’autorité compétente de l’État membre est convaincue que le demandeur potentiel a l’intention de solliciter une autorisation ou le renouvellement ou le réexamen de celle-ci, elle lui fournit le nom et l’adresse du ou des titulaires des autorisations antérieures correspondantes et communique en même temps le nom et l’adresse du demandeur à ces derniers.

However, given, on the one hand, the difficulty the holder has in asserting his right to information, (in practice, examination of a plant does not reveal whether it was obtained by the use of the product of the harvest or by the purchase of seed), and, on the other hand, the obligation to safeguard the legitimate interests of both the breeder and the farmer, the holder must be authorised to request information from a farmer where he has some indication that the latter has relied or will rely on the "agricultural exemption".
Toutefois, vu, dune part, la difficulté pour le titulaire de mettre en oeuvre son droit à linformation, (en pratique, lexamen d'une plante ne permet pas d'établir si elle a été obtenue par l'utilisation du produit de la récolte ou par l'acquisition de semences) et, d'autre part, l'obligation de sauvegarder les intérêts légitimes réciproques de l'obtenteur et de l'agriculteur, le titulaire doit pouvoir demander des informations à un agriculteur dès qu'il dispose d'un indice que ce dernier a exercé "le privilège de l'agriculteur".

The holder of an authorisation may not claim that he is entitled to specific protection of his interests where the competent authority establishes that the medicinal product no longer meets the criteria of therapeutic efficacy and safety on which the marketing authorisation was based, taking into account the progress of scientific knowledge and new data collected in particular in the context of pharmacovigilance.
Le titulaire d'une autorisation ne peut prétendre à aucune protection spécifique de ses intérêts, si l'autorité compétente établit que le médicament ne répond plus aux critères d'efficacité thérapeutique et de sécurité qui ont fondé l'AMM, compte tenu de l'évolution des connaissances scientifiques et des données nouvelles recueillies notamment dans le cadre de la pharmacovigilance.

These sanctions shall be determined having regard to the seriousness of the infringement committed by the holder of the Community authorisation and having regard to the total number of certified true copies of that authorisation that he holds in respect of international traffic.

Moreover, the Commission has decided to send reasoned opinions (the second stage of the infringement procedure laid down in Article 169 of the Treaty) to five Member States for the following reasons: Germany maintains discriminatory requirements for parallel importers of medicinal products; a Belgian law obstructs the marketing of certain blood products even when they have a Community authorisation; despite payment of a Community fee Sweden charges a national fee to holders of a Community marketing authorisation for medicinal products; the United Kingdom does not take sufficient steps to prevent plant-based medicines being marketed as food supplements; finally, Portugal has not correctly transposed the Directive on personal protective equipment.
De plus la Commission a décidé d'envoyer des avis motivés (seconde étape de la procédure d'infraction prévue par l'article 169 du traité) à cinq Etats membres pour les raisons suivantes: l'Allemagne maintient des exigences disciminatoires pour l'importateur parallèle de médicaments. Une loi belge fait obstacle à la mise sur son marché de certains dérivés sanguins pourtant munis d'une autorisation communautaire. La Suède demande le paiement d'une redevance nationale aux titulaires d'une autorisation communautaire de mise sur le marché des médicaments alors qu'ils ont déjà acquitté une redevance communautaire. Le Royaume-Uni ne prend pas de mesures suffisantes afin d'assurer que ne soient mis sur le marché comme compléments alimentaires des médicaments à base de plantes. Enfin le Portugal n'a pas correctement transposé la directive sur l'équipement de protection individuelle.
