In his Opinion delivered today, Advocate General Yves Bot notes that the Court of Justice has already stated that, even though the institutions of the EU have only a limited freedom of action in giving effect to international law and without calling into question the primacy of a Security Council resolution at the international level, requiring Community institutions to pay due regard to the institutions of the UN cannot result in their abstaining from reviewing the lawfulness of Community measures in the light of fundamental rights. It would, in his view, be wrong for the Court to reverse its decision not to grant immunity from review to an act such as the contested regulation.

Yves Bot, rappelle que la Cour a déjà précisé que, sans remettre en cause la primauté d’une résolution du Conseil de sécurité au plan international, le respect s’imposant aux institutions européennes à l’égard des institutions des Nations unies ne pouvait avoir pour conséquence d’empêcher tout contrôle de la légalité d’un acte de l’Union au regard des droits fondamentaux, même si les institutions de l’Union ne disposent que d’une faible marge de manœuvre pour mettre en œuvre le droit international.

Community institutions and bodies would take into account the outcome of the public participation in taking a decision on a plan or programme relating to the environment and inform the public about it; databases or registers should include information on steps taken in proceedings for infringement of Community law; a delay of 15 working days for an answer from the Community institutions or bodies to a request for access to information would be established; Community institutions and bodies have to interpret any grounds for refusing access to information in a restrictive way, taking into account the public interest served by disclosure and whether the information relates to emissions into the environment; extension to eight weeks of the delay to receive comments from the public to plans and programmes; extension to six weeks of the delay for any non-governmental organisation to present a request for the review of a Community act; the regulation would be applicable 9 month after its entry into force.

Given that acts adopted by a Community institution or body acting in a judicial or legislative capacity can be excluded, the same should apply to other inquiry procedures where the Community institution or body acts as an administrative review body under provisions of the Treaty.

(19) To ensure adequate and effective remedies, including those available before the Court of Justice of the European Communities under the relevant provisions of the Treaty, it is appropriate that the Community institution or body which issued the act to be challenged or which, in the case of an alleged administrative omission, omitted to act, be given the opportunity to reconsider its former decision, or, in the case of an omission, to act.

Paradoxically, all legal acts of the Member States are subject to scrutiny as regards their implications for human rights by the Commission and Court of Human Rights set up by the Convention of 4 November 1950,1 whereas the acts of the Community are not. The Community institutions enjoy, as it were, some sort of "immunity", which could well be prejudicial to the rights of the Community's citizens.

Once the Community is a party to the Convention, the acts of the Community institutions will be subject to scrutiny by the Strasbourg authorities, in the same way as the acts of the Member States, including the decisions of their constitutional courts and supreme courts.
