Taking account of the principle of separation and the establishment of the Supervisory Board and the Administrative Board of Review, two distinct procedures should apply: (a) where the ECB contemplates the imposition of administrative penalties in the exercise of its supervisory tasks, decisions to this effect are taken by the Governing Council of the ECB based on a complete draft decision from the Supervisory Board and subject to review by the Administrative Board of Review; and (b) where the ECB contemplates the imposition of sanctions in the exercise of its non-supervisory tasks, decisions to this effect are taken by the Executive Board of the ECB and subject to review by the Governing Council of the ECB.

4. The limitation period for the imposition of periodic penalty payments shall be suspended for as long as the decision of the Commission is the subject of proceedings pending before the Court of Justice of the European Union.

If the administering State adopts the procedure of conversion of the penalty, that State (a) will be bound by the findings as to the facts in so far as they appear explicitly or implicitly in the judgment handed down in the sentencing State; (b) may, unless it has made a declaration to the contrary, convert a custodial penalty into a financial penalty if the penalty is less than or equal to a period of six months; and (c) may not aggravate the penal position of the sentenced person and will not be bound by any minimum penalty which its own law may provide for the offence or offences committed (Article 8(5)).

Where the transfer of enforcement of a custodial penalty is accepted, the competent authorities in the administering State must either enforce the penalty imposed in the sentencing State - immediately or through an order - or through a judicial or administrative procedure convert the sentence into a decision of the administering State, thereby substituting the penalty imposed in the sentencing State by a penalty laid down by the law of the administering State for the same offence (Article 8).

I consider that a legal area as called for in Tampere requires the unbureaucratic transmission and enforcement of judgements in criminal cases and that this initiative is a first step towards a comprehensive application of the principle of mutual recognition. I particularly endorse the provisions relating to the law to be applied, alternative custodial penalties and the amnesty, pardon or commutation of financial penalties.
À mes yeux, un espace juridique, tel qu'il a été exigé à Tampere, suppose la transmission et l'exécution des décisions pénales sans interventions bureaucratiques et cette initiative constitue un premier pas dans la voie d'une application globale du principe de la reconnaissance mutuelle. Je me rallie notamment aux dispositions relatives au droit applicable, à la peine de substitution privative de liberté et à la diminution ou à la remise de la sanction pécuniaire.

She particularly endorses the provisions relating to the law to be applied, alternative custodial penalties and the amnesty, pardon or commutation of financial penalties, and the scope for the Executing State to reduce the penalty if the judgment related to acts carried out on its territory or that of a Member State other than the Issuing State (Article 5(2)).
Votre rapporteur se rallie notamment aux dispositions relatives au droit applicable, à la peine de substitution privative de liberté et à la diminution ou à la remise de la sanction pécuniaire.
