Article 34(1) of Regulation No 44/2001 must be interpreted as meaning that neither the detailed rules for determining the amount of the sums which are the subject of the provisional and protective measures granted by a judgment in respect of which recognition and enforcement are requested, in the case where it is possible to follow the line of reasoning which led to the determination of the amount of those sums, and even where legal remedies were available which were used to challenge such methods of calculation, nor the mere invocation of serious economic consequences constitute grounds establishing the infringement of public policy of the Member State in which recognition is sought which would permit the refusal of recognition and enforcement in that Member State of such a judgment given in another Member State.

Member States retain the freedom to determine the requirements of public policy and public security in accordance with their needs, which can vary from one Member State to another and from one period to another. However, when they do so in the context of the application of the Directive, they must interpret those requirements strictly[34].

Takes the view that the Court of Justice has performed a decisive role in making the Community and the Union a 'Community' and a Union of law, in particular as a result of the fruitful dialogue between national and European judges in connection with the task of providing preliminary interpretations which the Treaties confer on the Court; supports the proposal put forward by the European Council in the programme adopted at The Hague to strengthen dialogue between the supreme courts of the Member States, and takes the view that such steps not only demonstrate the determination of the highest courts to share their experience, but also constitute the beginnings of a European public policy which finds its rationale in the shared objective of protecting fundamental rights;

The biggest and most difficult tasks for our 2005 presidency have to do with finance policy; its agenda is dominated by the determination of the financial framework for the period from 2007 to 2013 and by a more flexible interpretation of the Stability and Growth Pact.
