2 (1) Subject to subsection (2) and section 3, if the Board requires a first nation to enter into a co-management arrangement or assumes third-party management and appoints a person who is not an employee of the Board to act as an agent of the Board for the purposes of the co-management arrangement or third-party management, the scope of the authority of the person shall be set out in writing and a copy provided to the council of the first nation without delay.

These boards will act as institutions of public government within an integrated system of land and water management in the Mackenzie Valley.

What this amendment is trying to do is set some parameters around the kind of reporting, and suggesting that if a first nation has been issued with a financial management certificate by the First Nations Financial Management Board, the act would not apply because the first nation has met with a lot of respect in the financial administration of the first nations and has been approved by the board.
