IN-CONTEXT TRANSLATIONS

Based on data reported by Member States according to article 118 of the Control Regulation and on Commission observations derived from audits, verifications and inspections carried out according to Title X of the Control Regulation the Commission considers that Member States have implemented the main obligations of the Control Regulation and have set up the necessary instruments, procedures and standards for ensuring monitoring and inspection of fishing activities throughout the EU.
Sur la base des données communiquées par les États membres conformément à l’article 118 du règlement de contrôle et les observations de la Commission découlant des audits, des vérifications et des inspections menés conformément au titre X dudit règlement, cette dernière estime que les États membres ont mis en œuvre les principales obligations du règlement et ont mis sur pied les instruments, les procédures et les normes nécessaires pour garantir la surveillance et l’inspection des activités de pêche dans l’Union européenne.

4. Where, following port State inspection, a flag State Party receives an inspection report indicating that there are clear grounds to believe that a vessel entitled to fly its flag has engaged in IUU fishing or fishing related activities in support of such fishing, it shall immediately and fully investigate the matter and shall, upon sufficient evidence, take enforcement action without delay in accordance with its laws and regulations.
4. Lorsqu’à la suite d’une inspection effectuée par l’État du port, une partie qui est un État du pavillon reçoit un rapport d’inspection indiquant qu’il existe de sérieuses raisons de penser qu’un navire autorisé à battre son pavillon s’est livré à la pêche INDNR ou à des activités liées à la pêche en soutien à la pêche INDNR, elle mène une enquête immédiate et complète sur la question et si elle dispose d’indications suffisantes, elle prend sans attendre les mesures coercitives prévues par ses lois et règlements.

1. If an infringement has been detected as a result of an inspection carried out in accordance with Article 80, the inspecting Member State shall without delay submit a summary inspection report to the coastal Member State or, in case of an inspection outside Community waters, to the flag Member State of the fishing vessel concerned.

In the case of the inspection of a fishing vessel flying the flag of another Member State, a copy of the inspection report shall be sent without delay to the flag Member State concerned if an infringement has been found in the course of the inspection.
Lorsque le navire de pêche inspecté bat le pavillon d’un autre État membre, une copie du rapport d’inspection est envoyée sans tarder à l’État membre du pavillon concerné si une infraction a été constatée au cours de l’inspection.

In the case of the inspection of a fishing vessel flying the flag of a third country, a copy of the inspection report shall be sent without delay to the competent authorities of the third country concerned if an infringement has been found in the course of the inspection.
Lorsque le navire de pêche inspecté bat le pavillon d’un pays tiers, une copie du rapport d’inspection est envoyée sans tarder aux autorités du pays tiers concerné si une infraction a été constatée au cours de l’inspection.

3. The inspecting Member State shall immediately notify its decision not to authorise landing or transhipment operations taken in accordance with paragraph 2, accompanied by a copy of the inspection report, to the Commission or to a body designated by it, which shall immediately transmit it to the competent authority of the flag State of the inspected fishing vessel with a copy to the flag State or States of donor vessels where the inspected fishing vessel has engaged in transhipment operations.
3. L'État membre d'inspection notifie immédiatement à la Commission ou à un organisme qu'elle désigne sa décision de ne pas autoriser les opérations de débarquement ou de transbordement, prise conformément au paragraphe 2, en y joignant une copie du rapport d'inspection; la Commission ou l'organisme qu'elle désigne transmet immédiatement le rapport à l'autorité compétente de l'État du pavillon du navire de pêche inspecté, une copie étant adressée à l'État ou aux États du pavillon des navires donneurs dans les cas où le navire de pêche inspecté a procédé à des opérations de transbordement.
