IN-CONTEXT TRANSLATIONS

In accordance with Directive 2008/115/EC of the European Parliament and of the Council of 16 December 2008 on common standards and procedures in Member States for returning illegally staying third-country nationals , third-country nationals staying illegally on the territory of a Member State and holding a valid residence permit, or other authorisation offering a right to stay issued by another Member State such as a long-stay visa, should be required to go to the territory of that other Member State immediately.
Conformément à la directive 2008/115/CE du Parlement européen et du Conseil du 16 décembre 2008 relative aux normes et procédures communes applicables dans les États membres au retour des ressortissants de pays tiers en séjour irrégulier , les ressortissants de pays tiers qui séjournent illégalement sur le territoire d’un État membre et qui sont titulaires d’un titre de séjour en cours de validité ou d’une autre autorisation conférant un droit de séjour délivrés par un autre État membre, comme un visa de long séjour, devraient être dans l’obligation de se rendre immédiatement sur le territoire de cet autre État membre.

Any agreement whereby a collective management organisation mandates another organisation or organisations to grant multi-territorial licences in its own music repertoire for online use should not prevent the first-mentioned collective management organisation from continuing to grant licences limited to the territory of the Member State where that organisation is established, in its own repertoire and in any other repertoire it may be authorised to represent in that territory.

(2) Long-stay visas should be replaced by residence permits after the entry of third-country nationals into the territory of a Member State in due time in order to enable third-country nationals legally residing in one Member State on the basis of a long-stay visa to travel to the other Member States during their stay or transit through the territories of the other Member States when returning to their home country. However, long-stay visas are not replaced with residence permits by more and more Member States or are replaced only with considerable delays after the entry of third-country nationals into their territory.

2. Third-country nationals staying illegally on the territory of a Member State and holding a valid residence permit or other authorisation offering a right to stay issued by another Member State shall be required to go to the territory of that other Member State immediately.

Les ressortissants de pays tiers en séjour irrégulier sur le territoire d’un État membre et titulaires d’un titre de séjour valable ou d’une autre autorisation conférant un droit de séjour délivrés par un autre État membre sont tenus de se rendre immédiatement sur le territoire de cet autre État membre.

Where a Member State becomes aware of serious specific acts or circumstances relating to a service activity that could cause serious damage to the health or safety of persons or to the environment in its territory or in the territory of other Member States, that Member State shall inform the Member State of establishment, the other Member States concerned and the Commission within the shortest possible period of time.

Otherwise, such visas shall merely enable their holders to transit through the territories of the other Member States in order to reach the territory of the Member State which issued the visa, unless the holders do not fulfil the entry conditions referred to in Article 5(1)(a), (d) and (e) or are on the national list of alerts of the Member State through whose territory they seek to transit'.

The purpose of Council Directive 79/409 is the protection, balanced management and rational exploitation of wild birds in the territory of the Member States and migration is a cross-border phenomenon. Furthermore, the EU’s policy must take account of the changing habits of wild birds, in relation not only to Community territory, but the other areas where they are found. In view of the climatic and cultural differences between the various Member States and the different bird species found there, the Member States should be able to use their discretion in setting the dates of the hunting season (between 15 July and 28 February) whilst respecting precise criteria. Is the Commission willing to amend the directive, in particular Article 7(4) thereof, and hence prevent divergence in its application and a consequent legal dispute at Community and national level?
