Article 10 (2) sets out a number of optional jurisdictional grounds, which the Member States may inter alia choose to adopt.Article 10 (3) refers to the prosecution of the offences referred to in Articles 2 and 3 committed outside the territory of the Member State concerned and stipulates that "each Member State shall, in those cases referred to in point (b) of paragraph 1, and may, in those cases referred to in paragraph 2, take the necessary measures to ensure that its jurisdiction is not subject to either of the following conditions: (a) the acts are a criminal offence at the place where they were performed; or (b) the prosecution can be initiated only following a report made by the victim in the place where the offence was committed, or a denunciation from the State of the place where the offence was committed".

Concerning Article 10(3)(b), specifying that jurisdiction based on the principles of territoriality and active personality shall not be subject to the requirement that prosecution can be initiated only following a report made by the victim in the place where the offence was committed, or a denunciation from the State of the place where the offence was committed, none of the Member States have introduced such a requirement.

The bill seeks to put in place specific offences to leave Canada or to attempt to leave Canada to knowingly participate in any activity of a terrorist group for the purpose of enhancing the ability of any terrorist group to carry out or facilitate a terrorist activity; to knowingly facilitate a terrorist activity; to commit an indictable offence for the benefit of, at the direction of, or in association with a terrorist group; or to commit an indictable offence that also constitutes a terrorist activity.

This Directive does not govern conditions for exercising jurisdiction over any of the offences referred to herein, such as a report by the victim in the place where the offence was committed, a denunciation from the State of the place where the offence was committed, or the non-prosecution of the offender in the place where the offence was committed.

5. For the prosecution of any of the offences referred to in Articles 3 to 7 committed outside the territory of the Member State concerned, as regards paragraph 1(b) of this Article, each Member State shall take the necessary measures to ensure that its jurisdiction is not subordinated to the condition that the prosecution can only be initiated following a report made by the victim in the place where the offence was committed, or a denunciation from the State of the place where the offence was committed.
5. Four years ago the former Liberal government put in place this offence with a sentence that was thought to be appropriate under the circumstances.

[4] CY law specifies what is regarded as "sufficient information", for example the full name, date and place of birth of the individual in respect of whom the conviction has been handed down; the date of the conviction, name of the court and the date on which the decision became final; information on the offence leading to the conviction and, specifically, the date the offence was committed, the name or legal definition of the offence, and the references of the legal provisions applied; information on the content of the conviction and, chiefly, on the offence, any additional sanctions, security measures and subsequent decisions amending the execution of the conviction.

Whereas the current Act is based on re- education and rehabilitation of the young person, placing the offence in the context of the young person's behaviour and whatever difficulties the young person may have at home, at school or in the community, the proposed reform favours an approach based on the seriousness of the offence and on punishment and deterrence.
