As previously noted, that term is not currently defined in the Railway Safety Act, and so by virtue of section 4(4) of that Act, one must look to Part III (railway transportation) of the Canada Transportation Act, where the term is generally defined to mean a company holding a certificate of fitness issued by the Canadian Transportation Agency.
