This Recommendation respects the fundamental rights and observes the principles recognised in particular by the Charter.

The former reinforces guarantees safeguarding the fundamental right to asylum, in particular, by strengthening the right to access asylum procedures (Articles 18 and 19), whereas the latter includes improved and clearer standards to more effectively safeguard the fundamental right to dignity, especially as regards vulnerable asylum seekers and further harmonises the rules on detention, laying down clear and restrictive grounds, conditions for detention, and guarantees for detainees (Articles 1, 4, 6, 7, 18, 21, 24, and 47).

We would prefer to see the Human Rights Commission as the body that makes recommendations which start the regulation making process and we would also prefer at the end of the day that the regulations adopted respect the recommendations of the Human Rights Commission.

The Human Rights Council can make recommendations to promote human rights, as well as technical assistance and capacity-building, and promote mainstreaming of human rights within the United Nations which will allow the Council to make recommendations to all relevant bodies, including the Security Council, and to all Member States.
