The Commission notes that the new Law on organisation and proceedings no longer contains a number of provisions of the Law of 22 July 2016 identified as a concern in its Recommendation of 27 July 2016, in particular provisions on the referral of cases to the full bench, on the handling of cases in chronological order, on the postponement of deliberations, on the possibility of the Public Prosecutor-General to prevent the examination of cases and on the transitional provisions for pending cases.

2. When a case is of exceptional importance, and in particular when the decision may affect the unity and consistency of the case law of the Court, the Court of Appeal may decide, on the basis of a proposal from the presiding judge, to refer the case to the full Court.
