5. The inventory of assets shall be updated to incorporate data on new infrastructure and rolling stock and on renewal or upgrading work done to existing infrastructure and rolling stock.

(b) if the recipient retains continuous possession or use of the rolling stock under an agreement (in this paragraph referred to as the “renewal agreement”) with the supplier that immediately succeeds the particular agreement, subsection (3) applies as if the renewal agreement were the first arrangement between the supplier and the recipient for the supply of the rolling stock.

(4) A receiver appointed pursuant to subsection (3) shall take possession of such railway, or of such section, and of all the railway stock, equipment and other accessories thereof, and shall, under the direction of the Court, carry on the working and operating of the railway or section or any part thereof, and shall keep and maintain the road, rolling stock, equipment and other accessories thereof in good condition, and renew the same or any part thereof, and, generally shall do all acts necessary for the preservation, working, maintenance, administration and operation of the railway or section, and shall, in the name of the company, institute or defend any suits or actions on its behalf.
(4) Un séquestre nommé en conformité du paragraphe (3) prend possession du chemin de fer ou du tronçon de chemin de fer, de tout le matériel du chemin de fer, de son équipement et de ses autres accessoires. (2) If a supply of railway rolling stock is made in a particular province by way of lease, licence or similar arrangement for the first lease interval (within the meaning of subsection 136.1(1) of the Act) in the period during which possession or use of the rolling stock is provided under the arrangement, the supply of the rolling stock for each of the other lease intervals in that period is, despite subsection (1), made in that province.

8. Where, at any time within 10 years of the date that any railway rolling stock in respect of which remission is granted under this Order enters international service, that rolling stock is removed from that service and placed in domestic service in Canada for a period of more than 90 days in any calendar year, the manufacturer of the rolling stock shall repay to the Crown the entire amount of the remission so granted.
8. Si, dans les 10 années qui suivent la date d’affectation au service international de matériel roulant de chemin de fer à l’égard duquel une remise est accordée en vertu du présent décret, ce matériel roulant est retiré du service international et affecté au service national au Canada pendant plus de 90 jours au cours d’une année civile, le fabricant du matériel roulant doit rembourser intégralement à la Couronne le montant de la remise accordée.

10. For the purposes of subsection 215(2) of the Act, the value of railway rolling stock imported for use in international service in circumstances where the Railway Rolling Stock (International Service) Remission Order No. 4 applies and the rolling stock is temporarily diverted (within the meaning of that Order) shall be determined by the formula

where the examination concerns the practical part of train driving competences, the examiner shall be licensed as train driver and hold a complementary certificate authorising the use of infrastructure and the driving of rolling stock that is subject to the examination, or a similar type of line/rolling stock; when the examiner does not hold a valid certificate for the infrastructure/rolling stock of the examination, a driver holding the certificate for that infrastructure/rolling stock shall be present to the examination in accordance with Article 4(2)(e) of Directive 2007/59/EC.

‘Cost of material damage to rolling stock or infrastructure’ means the cost of providing new rolling stock or infrastructure, with the same functionalities and technical parameters as that damaged beyond repair, and the cost of restoring repairable rolling stock or infrastructure to its state before the accident, to be estimated by Railway Undertakings and Infrastructure Managers on the basis of their experience, including also costs related to the leasing of rolling stock, as a consequence of non-availability due to damaged vehicles.
