(2) If a person from whom payment of an amount has been demanded pursuant to subsection (1) has not paid the amount within 30 days after the day on which the demand is made, the Minister may deduct the amount from the person’s annuity, annual allowance or supplementary benefit, in approximately equal monthly instalments equal to ten per cent of the gross monthly amount of the annuity, annual allowance or supplementary benefit, as the case may be.
(2) Si la personne qui a été sommée de rembourser un montant aux termes du paragraphe (1) ne l’a pas acquitté dans les 30 jours suivant la date de la sommation, le ministre peut retenir le montant sur l’annuité, l’allocation annuelle ou la prestation supplémentaire de cette personne par des déductions mensuelles sensiblement égales représentant chacune 10 pour cent du montant brut des mensualités.

(3) However, if the contributor is on leave of absence without pay or if the contributor has ceased to be a member of the Force and is entitled to an annual allowance or a deferred annuity that has not yet become payable, the notice shall be sent to the contributor as soon as feasible after the day on which the contributor returns to work or the payment of the allowance or annuity begins.

The applicant alleges, in that regard, that there has been an infringement of Article 12(2a)(v) of the regulation on life-annuities applicable to Italian Members, to which reference is made in the Rules governing the payment of expenses and allowances to Members of the European Parliament, in that it has been wrongly used to support the suspension of pension payments to the President of the Venice Port Authority.

Where the parties to the contract amend or terminate the latter after the applicant has lodged a payment application, the applicant may maintain such payment application only on condition that, with a view to allowing the requisite inspections to be carried out, he informs the relevant competent authority of such amendment or termination, no later than the closing date set in the Member State concerned for amendment of the application.
