For the ACP States, the abolition of customs duties results in lost earnings from these duties, and a loss of funding needed for urgent public investment in infrastructure, the social sphere, support for economic development and improvement of administrative capacity.

Deplores the fact that in some cases Structural Fund allocations for infrastructure projects undertaken in the context of a Public Private Partnership (PPP) and related contracts with private operators based on public procurement carried out at sub-national level have, as a result of very complex procurement procedures, led to a loss of European Union subsidies previously available to fund infrastructure development; believes that it is vital to remove obstacles to PPPs if the European Union wants to have any chance of making the necessary investments in infrastructure and quality services; calls on the Commission to ensure that public procurement and Structural Fund implementation rules set a coherent framework for PPPs in order to create legal certainty for all stakeholders and reduce the pressure on public budgets, in the context of the principle of co-financing and in the aftermath of the global economic crisis;
5. déplore que dans certains cas, les crédits des Fonds structurels accordés à des projets d'infrastructure conçus dans le contexte d'un partenariat public–privé (PPP) et de contrats corollaires avec des opérateurs privés sur la base de marchés publics réalisés au niveau infranational aient été à l'origine, par suite de procédures de passation très complexes, d'une perte de subventions communautaires précédemment disponibles pour financer le développement de l'infrastructure; considère qu'il est essentiel de lever les obstacles auxquels se heurtent les PPP pour que l'Union européenne ait la possibilité de réaliser les investissements nécessaires dans l'infrastructure et la fourniture de services de qualité; invite la Commission à faire en sorte que les règles régissant les marchés publics et les Fonds structurels fixent un cadre cohérent pour les PPP en sorte de créer la sécurité juridique pour toutes les parties concernées et de réduire la pression sur les budgets publics, dans le contexte du principe du cofinancement et des suites de la crise économique mondiale;

Highlights the fact, however, that taken over a longer period the trend in losses in the EAGGF area is clearly downwards, whereas in the area of the Structural Funds a substantial increase has been seen; in 2000, for example, the loss reported in the EAGGF area still totalled EUR 474,6 million, whereas the loss in the area of the Structural Funds in the same year totalled no more than EUR 114,2 million; since then, the proportions of the frauds statistics accounted for by the two areas have almost been reversed;
