The agreement defines telework as a form of organising and/or performing work, using information technology, in the context of an employment contract/relationship, where work, which could also be performed at the employer's premises, is carried out away from those premises on a regular basis.

Member States may, by law or by collective agreements, provide for more specific rules to ensure the protection of the rights and freedoms in respect of the processing of employees' personal data in the employment context, in particular for the purposes of the recruitment, the performance of the contract of employment, including discharge of obligations laid down by law or by collective agreements, management, planning and organisation of work, equality and diversity in the workplace, health and safety at work, protection of employer's or customer's property and for the purposes of the exercise and enjoyment, on an individual or collective basis, of rights and benefits related to employment, and for the purpose of the termination of the employment relationship.

If any contractor with Her Majesty, or any subcontractor in the construction of any public work let under contract by Her Majesty, defaults in the payment of the wages of any foreman, workman or labourer employed on the work, or in the payment of any sum due for the labour of any such foreman, workman or labourer, or of any team employed on the work, and if a claim therefor is filed, not later than two months after the payment becomes due, in the office of the minister entering into the contract on behalf of Her Majesty and satisfactory proof thereof is furnished, Her Majesty may pay the claim to the extent of the amount of all moneys or securities held by Her Majesty for securing the performance of the contract at the time of the filing of the claim.

(4) Where the Minister is satisfied that the accounts or records kept by a person with respect to the performance of a defence contract, or of defence contracts during any period referred to in paragraph (2)(b) or subsection (3), are insufficient to enable the cost of performance of the contract or contracts to be determined or that the cost as shown by the accounts or records is not fair and reasonable, the Minister is not limited or bound by the accounts or records in fixing the fair and reasonable cost of performance of the contract or contracts.

When they are required to rule on the use of successive fixed-term employment contracts, national courts must examine the circumstances of the case, taking into account the number of successive contracts concluded with the same person or for the purposes of performing the same work, in order to ensure that the use of such contracts is not abused by employers.

Consequently, in the case where the employee carries out hisactivities in more than one Contracting State, the Convention must be construed as guaranteeing the applicability of the first criterion referring to the law of the State in which the employee, in the performance of the contract, performs the greater part of his obligations towards his employer and thus to the law of the place in which or from which the employee actually carries out his working activities and, in the absence of such a centre of activities, to the law of the place where the employee carries out the greater part of his activities.

1. A contracting authority/entity may state in the contract documents, or be obliged by a Member State so to state, the body or bodies from which a candidate or tenderer may obtain the appropriate information on the obligations relating to taxes, to environmental protection, to the employment protection provisions and to the working conditions which are in force in the Member State, region, locality or third country in which the works are to be carried out or services are to be provided and which shall be applicable to the works carried out on site or to the services provided during the performance of the contract.
