Member States may exclude a third-country national or a stateless person from being eligible for subsidiary protection if he or she, prior to his or her admission to the Member State concerned, has committed one or more crimes outside the scope of paragraph 1 which would be punishable by imprisonment, had they been committed in the Member State concerned, and if he or she left his or her country of origin solely in order to avoid sanctions resulting from those crimes.
3. Les États membres peuvent exclure tout ressortissant d’un pays tiers ou apatride des personnes pouvant bénéficier de la protection subsidiaire si, avant son admission dans l’État membre concerné, il a commis un ou plusieurs crimes qui ne relèvent pas du champ d’application du paragraphe 1 et qui seraient passibles d’une peine de prison s’ils avaient été commis dans l’État membre concerné, et s’il n’a quitté son pays d’origine que dans le but d’échapper à des sanctions résultant de ces crimes.

Without prejudice to Articles 5 and 7, a contract concluded by a natural person for a purpose which can be regarded as being outside his trade or profession (the consumer) with another person acting in the exercise of his trade or profession (the professional) shall be governed by the law of the country where the consumer has his habitual residence, provided that the professional:
