His Excellency the Governor General in Council, on the recommendation of the Minister of Employment and Immigration, pursuant to subsection 65(1)Footnote of the Immigration Act, is pleased hereby to approve the annexed Rules governing the activities of, and the practice and procedure in, the Adjudication Division of the Immigration and Refugee Board, made by the Chairperson of the Immigration and Refugee Board, in consultation with the Director General (Adjudication Division), the Deputy Chairperson (Convention Refugee Determination Division) and the Deputy Chairperson (Immigration Appeal Division), effective February 1, 1993.

Division 9 amends the Immigration and Refugee Protection Act (IRPA) in these separate areas: it modifies two elements of the Temporary Foreign Worker program,44 and it changes provisions regarding refugee protection decisions made by the Immigration and Refugee Board of Canada.

The European Pact on Immigration and Asylum of 16 October 2008 provided further political endorsement for this objective, by inviting the Commission to present proposals for establishing, in 2010 if possible and in 2012 at the latest, a single asylum procedure comprising common guarantees and for adopting a uniform status for refugees and the beneficiaries of subsidiary protection.

In the EESC's view, the proposed changes regarding the status of BEREC, e.g. a full-time post of chairperson of the Board of Regulators, may prove insufficient in the light of competitiveness challenges and the need to create investment incentives, particularly regarding broadband communications and the NGN/NGA network.

With regard to the parliamentary secretary's contention that this amendment provides new powers and a new mandate to the Immigration and Refugee Board beyond what is provided in the Immigration and Refugee Protection Act, I would submit that denial of citizenship to an adopted child is a de facto denial of an immigration visa and permanent resident status to that child and, as such, the Immigration and Refugee Board is exactly the body that exercises judgment and rules on such cases.

The amendment would provide new powers and a new mandate to the Immigration and Refugee Board beyond what is provided in the Immigration and Refugee Protection Act which creates the board and limits the board's role to immigration and refugee matters but would not involve citizenship.
