‘air fares’ means the prices expressed in euro or in local currency to be paid to air carriers or their agents or other ticket sellers for the carriage of passengers on air services and any conditions under which those prices apply, including remuneration and conditions offered to agency and other auxiliary services;

(11) It is furthermore desirable to lay down clear and detailed guidance as to the factors which may be relevant for the determination of whether the subsidised or unfairly priced air services provided by non-Community air carriers have caused injury or are threatening to cause injury; in order to demonstrate that the pricing practices related to the supply of such air services cause injury to the Community industry, attention should be given to the effect of other factors, and consideration should be given to all relevant and known factors and economic indicators which have a bearing on the state of the industry, and in particular prevailing market conditions in the Community.
(11) Il convient en outre de fixer des orientations claires et détaillées en ce qui concerne les facteurs qui peuvent contribuer à déterminer si les services aériens subventionnés ou proposés à des prix déloyaux qui sont fournis par des transporteurs aériens non communautaires ont causé ou menacent de causer un préjudice; afin de démontrer que les pratiques tarifaires liées à la fourniture de ces services aériens causent un préjudice à l'industrie communautaire, il convient de tenir compte de l'influence d'autres facteurs et de prendre en considération tous les éléments connus et pertinents ainsi que les indices économiques qui influent sur la situation de l'industrie, notamment les conditions de marché qui prévalent dans la Communauté.

4. A measure shall be imposed in the appropriate amounts in each case, on a non-discriminatory basis, on air services supplied by all non-Community air carriers found to benefit from subsidies or engaged in unfair pricing practices on the respective routes, except for air services supplied by those non-Community air carriers for which undertakings under the terms of this Regulation have been accepted.
4. Une mesure d'un montant approprié peut être imposée dans chaque cas sur une base non discriminatoire, pour les services de transport aérien fournis par tous les transporteurs aériens non communautaires dont il est avéré qu'ils bénéficient de subventions ou qu'ils mettent en oeuvre des pratiques tarifaires déloyales sur les routes concernées, à l'exception des services de transport aérien fournis par les transporteurs aériens non communautaires pour lesquels des engagements ont été acceptés aux termes du présent règlement.

3. The level of measures imposed to offset unfair pricing practices benefiting from a non-commercial advantage, shall not exceed the difference between the fares charged by the non-Community air carrier concerned and the air fares offered by the competing Community air carrier concerned, but should be less if such lesser level were to be adequate to remove the injury to the Community industry.

Le niveau des mesures imposées pour compenser les pratiques tarifaires déloyales de la part de transporteurs qui bénéficient d'un avantage non commercial ne doit pas dépasser la différence entre les tarifs pratiqués par le transporteur aérien non communautaire concerné et les tarifs aériens proposés par les transporteurs aériens communautaires concurrents concernés mais devrait être inférieur si ce niveau inférieur suffisait à éliminer le préjudice causé à l'industrie communautaire.

(9) It should be determined when an unfair pricing practice shall be deemed to exist; an examination of the pricing practices of a third-country air carrier should be restricted to those limited number of cases where the air carrier is benefiting from a non-commercial advantage which cannot be clearly identified as a subsidy.
(9) Il convient de déterminer dans quelles circonstances une pratique tarifaire déloyale est réputée exister; l'examen des pratiques tarifaires d'un transporteur aérien d'un pays tiers devrait être réservé au nombre limité de cas où ce transporteur bénéficie d'un avantage autre que commercial qui ne peut être clairement identifié comme une subvention.
