32. Considers it important to intensify cooperation with national parliaments, on the basis of Article 9 of Protocol No 1 annexed to the Treaties, and welcomes the agreement on the establishment of an interparliamentary conference in discussing budgetary and economic policies; stresses nevertheless that this cooperation should not be seen as establishing a new joint parliamentary body, which would be both ineffective and illegitimate from a democratic and constitutional point of view, and reaffirms that there is no substitute for a formal strengthening of the full legitimacy of the European Parliament, as a parliamentary body at Union level, with a view to reinforcing the democratic governance of the EMU;

26. To that end, it shall investigate serious matters relating to the discharge of professional duties constituting a dereliction of the obligations of officials and other servants of the Union liable to result in disciplinary or, as the case may be, criminal proceedings, or an equivalent failure to discharge obligations on the part of members of institutions and bodies, heads of offices and agencies or staff members of institutions, bodies, offices or agencies not subject to the Staff Regulations (hereinafter collectively referred to as ‘officials, other servants, members of institutions or bodies, heads of offices or agencies, or staff members’).

– to fully restore the prerogatives of the Constitutional Court as the supreme body of constitutional protection, and thus the primacy of the Fundamental Law, by removing from its text the limitations on the Constitutional Court’s power to review the constitutionality of any changes to the Fundamental Law, as well as the abolition of two decades of constitutional case law; to restore the right of the Constitutional Court to review all legislation without exception, with a view to counterbalancing parliamentary and executive actions and ensuring full judicial review; such a judicial and constitutional review may be exerted in different ways in different Member States, depending on the specificities of each national constitutional history, but once established, a Constitutional Court – like the Hungarian one, which after the fall of the communist regime has rapidly built a reputation among Supreme Courts in Europe – should not be subject to measures aimed at reducing its competences and thus undermining the rule of law;
– de restaurer entièrement les prérogatives de la Cour constitutionnelle en tant qu'organe suprême de protection constitutionnelle, et par conséquent la suprématie de la Loi fondamentale, en supprimant de son texte les limitations au pouvoir de la Cour constitutionnelle en matière de révision de la constitutionalité de toute modification de la Loi fondamentale ainsi que le rejet de deux décennies de jurisprudence constitutionnelle; de restaurer le droit de la Cour constitutionnelle de revoir toute la législation sans exception, en vue de contrebalancer les mesures parlementaires et exécutives et d'assurer un contrôle juridictionnel complet; si un tel contrôle juridictionnel et constitutionnel peut être exercé de différentes manières dans les divers États membres en fonction des spécificités de chaque histoire constitutionnelle nationale, une Cour constitutionnelle, une fois qu'elle est établie – comme la Cour constitutionnelle hongroise, qui, après la chute du régime communiste s'est rapidement forgée une réputation parmi les Cours suprêmes européennes – ne devrait pas faire l'objet de mesures visant à réduire ses compétences et à fragiliser ainsi l'état de droit;

No one has sought to prejudge what the Hungarian constitution will be or how it will be applied in practice and it will, of course, be subject to the checks and balances provided by the constitutional system, the constitutional balance of the Hungarian constitution itself and the fact that Hungary is subject to supranational bodies such as the Council of Europe and the European Union, which know about fundamental rights.

Under the body's constitution, national accreditation bodies from within the Community shall be entitled to be members of it, provided that they comply with the rules and objectives of the body and with the other conditions set out herein and as agreed with the Commission in the framework agreement.

(e) processing is carried out in the course of its legitimate activities with appropriate safeguards by a non-profit-seeking body which constitutes an entity integrated in a Community institution or body, not subject to national data protection law by virtue of Article 4 of Directive 95/46/EC, and with a political, philosophical, religious or trade-union aim and on condition that the processing relates solely to the members of this body or to persons who have regular contact with it in connection with its purposes and that the data are not disclosed to a third party without the consent of the data subjects.

6. A credit institution which, as defined in the first subparagraph of paragraph 5, is affiliated to a central body in the same Member State may also be exempted from the provisions of Article 5, and also Articles 40 to 51, and 65 provided that, without prejudice to the application of those provisions to the central body, the whole as constituted by the central body together with its affiliated institutions is subject to the abovementioned provisions a consolidated basis.
6. Les établissements de crédit qui, de la manière définie au paragraphe 5, premier alinéa, sont affiliés à un organisme central situé dans le même État membre peuvent aussi être exemptés de l'application de l'article 5 ainsi que des articles 40 à 51 et 65, pour autant que, sans préjudice de l'application desdites prescriptions à l'organisme central, l'ensemble constitué par l'organisme central et les établissements qui lui sont affiliés soit assujetti auxdites prescriptions sur une base consolidée.
