While the current Act causes considerable hardship and injustice because of the breadth of these provisions, it does at least contain mechanisms by which individuals’ particular circumstances can be taken into account—by grants of Ministerial relief or, in appropriate circumstances, a waiver of inadmissibility on humanitarian and compassionate grounds.

A court that imposes a sentence shall also take into consideration the following principles: (a) a sentence should be increased or reduced to account for any relevant aggravating or mitigating circumstances relating to the offence or the offender, and, without limiting the generality of the foregoing, (i) evidence that the offence was motivated by bias, prejudice or hate based on race, national or ethnic origin, language, colour, religion, sex, age, mental or physical disability, sexual orientation, or any other similar factor, (ii) evidence that the offender, in committing the offence, abused the offender’s spouse or child, or (iii) evidence that the offender, in committing the offence, abused a position of trust or authority in relation to the victim, shall be deemed to be aggravating circumstances; (b) a sentence should be similar to sentences imposed on similar offenders for similar offences committed in similar circumstances; (c) where consecutive sentences are imposed, the combined sentence should not be unduly long or harsh; (d) an offender should not be deprived of liberty, if less restrictive sanctions may be appropriate in the circumstances; and (e) all available sanctions other than imprisonment that are reasonable in the circumstances should be considered for all offenders, with particular attention to the circumstances of aboriginal offenders.

In addition to the aggravating circumstances already set out under section 380.1 of the Criminal Code and the general circumstances set out in section 718.2, sentencing courts will take these new aggravating circumstances into consideration in order to determine a sentence that reflects the specific facts of each case.

(23) The Commission should, in particular, be authorised to draw up a list of categories, types and degrees of seriousness of severe infringements which may under certain circumstances lead to the loss of the requisite good repute of road transport operators, to adapt to technical progress the Annex to this Regulation concerning the knowledge to be taken into consideration for the recognition of professional competence by the Member States and the Annex concerning the model certificate of professional competence, and to draw up the list of ▐infringements which may lead the authorities, under certain circumstances, and proportionate to the nature of the infringement, to consider suspending or withdrawing the authorisation to pursue the occupation or issuing a declaration of unsuitability.

Under these circumstances, consideration should be given to restricting the definition so that it does not simply cover all those persons entrusted with prominent public functions.
