TRADUCTIONS EN CONTEXTE

In accordance with the aim of that Communication, namely to ensure that only timber products which have been produced in accordance with the national legislation of the timber-producing country enter the Union, the Union has been negotiating Voluntary Partnership Agreements (FLEGT VPAs) with timber-producing countries (partner countries), which create a legally binding obligation for the parties to implement a licensing scheme and to regulate trade in timber and timber products identified in those FLEGT VPAs.
Conformément à l’objectif de ladite communication, à savoir faire en sorte que seuls les produits dérivés du bois ayant été produits conformément à la législation nationale du pays producteur de bois puissent entrer sur le territoire de l’Union, cette dernière négocie des accords de partenariat volontaires (APV FLEGT) avec les pays producteurs de bois (ci-après dénommés «pays partenaires»); ces accords font obligation aux parties de mettre en œuvre un régime d’autorisation et de réglementer les échanges commerciaux du bois et des produits dérivés spécifiés dans lesdits APV FLEGT.

Therefore, timber embedded in timber products listed in Annexes II and III to Council Regulation (EC) No 2173/2005 of 20 December 2005 on the establishment of a FLEGT licensing scheme for imports of timber into the European Community , originating in partner countries listed in Annex I to that Regulation, should be considered to have been legally harvested provided those timber products comply with that Regulation and any implementing provisions.
Il convient dès lors de considérer les bois utilisés dans les produits dérivés énumérés aux annexes II et III du règlement (CE) no 2173/2005 du Conseil du 20 décembre 2005 concernant la mise en place d’un régime d’autorisation FLEGT relatif aux importations de bois dans la Communauté européenne , originaires des pays partenaires figurant à l’annexe I dudit règlement, comme étant issus d’une récolte légale pour autant qu’ils respectent ledit règlement et toute disposition d’application.

‘placing on the market’ means the supply by any means, irrespective of the selling technique used, of timber or timber products for the first time on the internal market for distribution or use in the course of a commercial activity, whether in return for payment or free of charge. It also includes the supply by means of distance communication as defined in Directive 97/7/EC of the European Parliament and of the Council of 20 May 1997 on the protection of consumers in respect of distance contracts .

3a. Individual Member States shall not be prevented, with regard to access to the market for timber and timber products, from setting more stringent requirements for the harvesting and origin of timber than laid down in this Regulation, including requirements providing for the sustainable management of forests, protection of the environment, conservation of biodiversity and ecosystems, protection of local communities and their habitats, protection of forest-dependent communities, and respect for the rights of indigenous peoples and human rights.
3 bis. Pour l'accès au marché du bois et des produits dérivés, il n'est pas interdit à un État membre d'appliquer, au regard de la récolte et de l'origine du bois, des critères plus stricts que ceux du présent règlement, notamment des critères relatifs à la gestion durable des forêts, à la protection de l'environnement, à la conservation de la biodiversité et des écosystèmes, à la protection des communautés locales et de leurs milieux de vie, à la protection des communautés tributaires de la forêt ainsi qu'au respect des droits des populations indigènes et des droits de l'homme.

To that effect, timber products listed in Annexes II and III to Council Regulation (EC) No 2173/2005 of 20 December 2005 on the establishment of a FLEGT licensing scheme for imports of timber into the European Community, originating in partner countries listed in Annex I to that Regulation should be considered to have been legally harvested provided they comply with that Regulation and any implementing provisions.
À cet effet, il convient de considérer les bois et produits dérivés énumérés aux annexes II et III du règlement (CE) n° 2173/2005 du Conseil du 20 décembre 2005 concernant la mise en place d’un régime d’autorisation FLEGT relatif aux importations de bois dans la Communauté européenne, originaires des pays partenaires figurant à l’annexe I dudit règlement, comme étant issus d'une récolte légale pour autant qu’ils respectent ledit règlement et toute disposition d’application.

En cas d'autorisation de mise sur le marché de bois et de produits dérivés, il n'est pas interdit à un État membre d'appliquer, au regard de la récolte et de l'origine du bois, des critères plus stricts que ceux du présent règlement en ce qui concerne la durabilité, la protection de l'environnement, de la biodiversité et de l'écosystème, la protection des milieux de vie des communautés locales, la protection des communautés tributaires de la forêt, la protection et les droits de la population indigène et des droits de l'homme.

Under the licensing scheme, certain timber products exported from a partner country and entering the Community at any customs point designated for release for free circulation should be covered by a licence issued by the partner country, stating that the timber products have been produced from domestic timber that was legally harvested or from timber that was legally imported into a partner country in accordance with national laws as set out in the respective Partnership Agreement.
Dans le cadre du régime d’autorisation, certains bois et produits dérivés exportés à partir d’un pays partenaire et entrant sur le territoire de la Communauté à un poste de douane désigné pour être mis en libre pratique devraient être accompagnés d’une autorisation délivrée par le pays partenaire, attestant que les bois et produits dérivés sont issus de bois récolté légalement dans le pays ou de bois importé légalement dans un pays partenaire conformément à la législation nationale spécifiée dans l’accord de partenariat concerné.
