Relevant requirements exist in Union legal acts in relation to the development of plans and projects, in particular in Directive 2001/42/EC of the European Parliament and of the Council of 27 June 2001 on the assessment of the effects of certain plans and programmes on the environment (7), Directive 2003/35/EC of the European Parliament and of the Council of 26 May 2003 providing for public participation in respect of the drawing up of certain plans and programmes relating to the environment (8), Directive 2011/92/EU of the European Parliament and of the Council of 13 December 2011 on the assessment of the effects of certain public and private projects on the environment (9) and Directive 2012/18/EU of the European Parliament and of the Council of 4 July 2012 on the control of major-accident hazards involving dangerous substances (10).

This Directive should contribute to the fulfilment of the obligations and important commitments of the Community and the Member States under several relevant international agreements relating to the protection of the marine environment from pollution: the Convention on the Protection of the Marine Environment of the Baltic Sea Area, approved by Council Decision 94/157/EC , the Convention for the Protection of the Marine Environment of the North-East Atlantic, approved by Council Decision 98/249/EC , including its new Annex V on the Protection and Conservation of the Ecosystems and Biological Diversity of the Maritime Area and the corresponding Appendix 3, approved by Council Decision 2000/340/EC , the Convention for the Protection of the Marine Environment and the Coastal Region of the Mediterranean, approved by Council Decision 77/585/EEC , and its amendments from 1995, approved by Council Decision 1999/802/EC , as well as its Protocol for the Protection of the Mediterranean Sea Against Pollution from Land-Based Sources, approved by Council Decision 83/101/EEC , and its amendments from 1996, approved by Council Decision 1999/801/EC .

(10) All plans and programmes which are prepared for a number of sectors and which set a framework for future development consent of projects listed in Annexes I and II to Council Directive 85/337/EEC of 27 June 1985 on the assessment of the effects of certain public and private projects on the environment(7), and all plans and programmes which have been determined to require assessment pursuant to Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild flora and fauna(8), are likely to have significant effects on the environment, and should as a rule be made subject to systematic environmental assessment. When they determine the use of small areas at local level or are minor modifications to the above plans or programmes, they should be assessed only where Member States determine that they are likely to have significant effects on the environment.

Whereas, at their meeting on 29 October 1990, the Council (Environment and Energy Ministers) agreed that the Community and Member States, assuming that other leading countries undertook similar commitments, and acknowledging the targets identified by a number of Member States for stabilizing or reducing emissions by different dates, were willing to take actions aimed at reaching stabilization of the total CO2 emissions by 2000 at the 1990 level in the Community as a whole, and also that Member States which start from relatively low levels of energy consumption and therefore low emissions measured on a per capita or other appropriate basis are entitled to have CO2 targets and/or strategies corresponding to their economic and social development, while improving the energy efficiency of their economic activities;
considérant que, lors de sa session du 29 octobre 1990, le Conseil (ministres de l'environnement et de l'énergie) est convenu que la Communauté et les États membres, présumant que d'autres pays importants prendront des engagements similaires et reconnaissant les objectifs identifiés par un certain nombre d'États membres en vue de stabiliser ou de réduire les émissions avant différentes échéances, sont disposés à prendre des mesures pour parvenir à stabiliser, d'ici à l'an 2000, les émissions totales de CO2 au niveau de 1990 dans l'ensemble de la Communauté et que les États membres qui, au départ, ont une consommation énergétique relativement faible et donc des niveaux peu importants d'émission mesurés par habitant ou sur une autre base appropriée ont le droit d'avoir, en matière de CO2, les objectifs et/ou des stratégies en rapport avec leur développement économique et social, tout en continuant à améliorer le rendement énergétique de leurs activités économiques;

Whereas the aim of the Community environment policy as stated in the Declaration of the Council of the European Communities and of the representatives of the Governments of the Member States meeting in the Council of 22 November 1973 on the programme of action of the European Communities on the environment [3], supplemented by the resolution of the Council of the European Communities and of the representatives of the Governments of the Member States meeting within the Council of 17 May 1977 on the continuation and implementation of a European Community policy and action programme on the environment [4], namely the improvement of the quality and setting of life, of the surroundings and living conditions of the peoples of the Community, implies, in particular, preventing, reducing and as far as possible, eliminating pollution and nuisances as well as seeking common solutions to environmental problems with States outside the Community, particularly in international organizations;
considérant que l'objectif de la politique de l'environnement dans la Communauté, tel qu'il a été défini dans la déclaration du Conseil des Communautés européennes et des représentants des gouvernements des États membres, réunis au sein du Conseil, du 22 novembre 1973, concernant un programme d'action des Communautés européennes en matière d'environnement [3], complétée par la résolution du Conseil des Communautés européennes et des représentants des gouvernements des États membres, réunis au sein du Conseil, du 17 mai 1977, concernant la poursuite et la réalisation d'une politique et d'un programme d'action des Communautés européennes en matière d'environnement [4], à savoir l'amélioration de la qualité et du cadre de vie, du milieu ambiant et des conditions de vie des peuples qui en font partie, implique notamment la prévention, la réduction et, autant que possible, la suppression des pollutions et nuisances, ainsi que la recherche avec les États situés en dehors de la Communauté, des solutions communes aux problèmes d'environnement, dans le cadre notamment des organisations internationales;
