Criticises the fact that the issue of Western Sahara has not been placed on the agenda for the 2016 sessions of the HRC; emphasises once again that the Western Sahara conflict is a decolonisation issue and that, under international law, the Kingdom of Morocco has no sovereignty over Western Sahara and is regarded as the occupying power; condemns the persistent violation of the fundamental rights of the Sahrawi people; calls for the protection of the fundamental rights of the people of Western Sahara, including freedom of association, freedom of expression and the right to demonstrate; calls for the immediate release of all Sahrawi political prisoners and, as a matter of urgency, of the members of the Gdeim Izik group condemned by the Moroccan military tribunal; repeats its call to Spain to grant political asylum to the young Sahrawi Hassana Aalia, sentenced by a court to life imprisonment; stresses the need for international monitoring of the human rights situation in Western Sahara; calls on Morocco and the Polisario Front to continue the negotiations which are designed to lead to a peaceful and lasting solution to the Western Sahara conflict, and reaffirms the right of the Sahrawi people to self-determination, which must be decided by a democratic referendum held in accordance with United Nations Resolutions 34/37 and 35/19;

Welcomes the proceedings of the UPR for Egypt in November 2014 and looks forward to its adoption at the upcoming session of the UNHRC; urges Egypt to immediately and unconditionally release all those detained for peacefully exercising their rights to freedom of expression, assembly and association; demands, also, that the Government of Egypt enact legislation in line with international standards and safeguard the right to association enshrined in the Egyptian Constitution, including the right to receive and dispense funding, and that it revoke the Protest Law of November 2013 and introduce new legislation that would guarantee freedom of assembly; urges the Egyptian Government to open a judicial investigation to determine the identity of those responsible for ordering and carrying out unlawful killings in the course of the suppression of the mainly peaceful demonstrations that have taken place since 3 July 2013, including the dispersals of 14 August 2013 in Raba’a Square and Nahda Square, in which at least 1 000 protesters were killed;

258 (1) If a district within which a court, justice of the peace or provincial court judge has jurisdiction either under this Act or under any other Act or at common law, for any purpose whatever, is situated on the coast of a sea, or abuts on or projects into navigable waters, the court, justice or provincial court judge has jurisdiction over any vessel on, or lying or passing off, that coast or in or near those navigable waters, and over all persons on board, in the same manner as if the vessel or persons were within the limits of the original jurisdiction of the court, justice or provincial court judge.

A writ of certiorari may, by order of the Court or a judge, issue out of the Court to bring up any papers or other proceedings had or taken before any court, judge or justice of the peace, and that are considered necessary with a view to any inquiry, appeal or other proceeding had or to be had before the Court.
