This Sector Understanding sets out the financial terms and conditions that apply to officially supported export credits relating to contracts in a sector listed in Appendix II of this Sector Understanding. Specific support for certain agricultural activities should be based on a strict understanding of the provisions of Article 68 and the new delegated acts should require that the granting of such coupled support should be adequately justified to the Commission and checked by it; notes that to be able to assume its ultimate responsibility under the system of shared management, the Commission should play a more active role in establishing the criteria governing the implementation of the measures, and in assessing measures in a comparative way to avoid unexplained and extreme variations in prices, such as those identified in the examples for goats in this Special Report; notes that the legal tools to do this should be established in the new delegated acts; notes that the Member States should be required, in the new delegated acts, to demonstrate that each specific support measure which they intend to introduce is necessary (in terms of the need for and added value of an approach based on derogations), relevant (in terms of implementation arrangements, award criteria and aid levels), and that it satisfies the criteria of sound financial management; in particular and in response to the point expressed by the Court of Auditors that ‘clearly defined cases’ were not clearly defined, implementation of the new Regulation (EU) No 1307/2013 should overcome the problems identified, by Member States:

24. Recalls that both the Plant Protection Products Regulation (Regulation (EC) No 1107/2009 of 21 October 2009) and the new Biocides Regulation (Regulation (EU) No 528/2012 of 22 May 2012) require the Commission to specify scientific criteria for the determination of endocrine-disrupting properties by December 2013; is concerned that these criteria will remove significant substances which could still be used with acceptable risk; emphasises how important it is that the procedure should be transparent, so that the market actors concerned understand the scientific basis for the decisions and are aware of the actors who were involved in developing new criteria; urges the Commission to fully consider the impact of different approaches when presenting proposals for endocrine disruptors;

Those criteria should be market-oriented and limited to the most significant environmental impacts of products during their full lifecycle, including the phases of both manufacturing and use.

Understands, in view of the proliferating case-law, the widespread legal uncertainty that has grown up as to the application of in-house criteria and therefore calls on the Commission to devise criteria, based on the current case-law of the Court of Justice, that establish a stable frame of reference for public authority decision-making, and to consider the possibility of incorporating these criteria into Community legislation;
