Calls on the Member States to take on responsibility for guaranteeing the right to housing for everyone, in particular by launching housing programmes for less well-off citizens, providing incentives to promote controlled-cost housing, constructing social rented housing, promoting and financing self-building programmes, supporting the cooperative sector, launching effective and non-speculative credit policies and regulating a non-speculative rental market;

6. Notes that investment in social housing plays an important part in implementing other policy areas and has, inter alia, a beneficial impact on the local economy in terms of growth and job creation, on social inclusion and on the fight against impoverishment, on support for local micro-enterprises and SMEs and on the promotion of occupational mobility; furthermore, healthy housing promotes individual well-being and public health and protects the environment in general; in this context, underlines the need to explore and define best practices, to strengthen the capacity of local and regional authorities and to evaluate their progress in implementing these best practices;
6. note que les investissements dans le logement social jouent un rôle important dans la mise en œuvre d'autres politiques et qu'ils ont notamment une retombée positive sur l'économie locale sous forme de croissance, de création d'emplois, d'insertion sociale et de lutte contre la paupérisation, de soutien aux micro-entreprises et aux PME locales ainsi que de promotion de la mobilité professionnelle; fait en outre observer qu'un habitat sain contribue au bien-être et la santé des citoyens tout en protégeant l'environnement en général; insiste, à cet égard, sur la nécessité d'explorer et de définir les bonnes pratiques, de renforcer la capacité des pouvoirs locaux et régionaux et d'évaluer les progrès réalisés dans la mise en œuvre de desdites pratiques;

54. Invites the Member States and the relevant authorities to simplify the process of applying for social housing and to make the allocation of homes more fair, transparent and impartial, according to the specific social, economic and cultural circumstances of each Member State, with a view to eliminating discrimination and to preventing any ‘avoidance effect’ for particularly vulnerable groups, a phenomenon which has the effect of aggravating residential spatial segregation and creating ghettos; draws attention, in this regard, to the pertinence of arrangements employed in some Member States, such as a list of legally defined, precise and transparent allocation criteria to encourage a social mix, anonymised applications for social housing, the advertising of vacant properties, the introduction of rating systems for housing applications, clear separation between the bodies which determine the criteria and those which allocate housing, and appropriate governance arrangements for the allocation of housing in order to promote broad based social mixing;
54. invite les États membres et les autorités responsables à simplifier les demandes de logements sociaux et à améliorer l'équité, la transparence et l'impartialité dans l'attribution des logements, compte tenu de leur réalité économique, sociale et culturelle, en vue d'enrayer toute discrimination et tout phénomène d'évitement des populations les plus vulnérables qui conduisent à renforcer la ségrégation spatiale et à créer des ghettos; souligne à ce titre la pertinence des dispositifs en vigueur dans certains États membres comme une liste de critères d'attribution légaux, précis et transparents favorisant la mixité sociale, l'anonymisation des demandes de logement social, la publicité des logements vacants, l'instauration de systèmes de cotation des dossiers de demandes, la séparation des instances contrôlant les critères et procédant à l'attribution des logements, et une gouvernance appropriée dans l'attribution en vue de favoriser la mixité sociale à large échelle;

18. Takes the view that, given the complexity of the issues affecting housing, an integrated approach, rooted in the principles of subsidiarity and proximity, should be adopted, so as to ensure the simultaneous introduction of various factors which would promote access to housing, improve building quality, improve quality of life for all generations and promote the attractiveness of both urban and rural environments;
18. considère que, face à la complexité des facteurs ayant une incidence sur le logement, il est nécessaire d'adopter une approche intégrée – ancrée dans les principes de subsidiarité et de proximité – qui assurerait la mise en place simultanée des différents éléments permettant de faciliter l'accès au logement et d'améliorer la qualité de la construction, la qualité de vie toutes générations confondues et l'attractivité des milieux tant urbains que ruraux;

The cases are similar to that involving the transfer of the Housing Promotion Agency (Wohnungsbauförderanstalt) to WestLB, where the Commission decided in 1999 to recover aid amounting at the time to some €800 million.

The Housing Promotion Institute (Wohnungsbauförderungsanstalt - "WfA"), which was the property of the Land, was transferred to WestLB by the Land authorities against payment of only 0.6%; this was not the behaviour of a provider of capital operating under market conditions.

(21) This Regulation lays down a number of obligations on promoters to ensure that, in the event of their breaching obligations relating to the use and communication of sales promotions, complainants will be able to identify the promoter and have easy access to in-house redress systems; the provisions of this Regulation will also encourage best-practice in the field of in-house customer complaint schemes as well as promote and facilitate the access to affordable out of-court redress schemes .
