Few people know what the sentencing provisions are for impaired driving, and it is inconceivable that there is a group of people who would drink and drive assuming they would be apprehended and sentenced to a minimum 90-day sentence but not drink and drive if they knew they faced a 120-day sentence for their third impaired driving offence.

'driving under the influence of drugs' means driving while impaired by drugs or other substances having a similar effect, as defined in the law of the Member State of the offence;

Amongst the provisions in Bill C-82 was one that raised the Criminal Code's minimum period of driving prohibition on a first impaired driving offence from three months to one year; on the second offence, the minimum was raised from six months to two years; and for a subsequent offence, the minimum period of driving prohibition was raised from 12 months to three years.
