Error of law consisting in stating, as regard audit report 11-INFS-025, that Rose Vision ‘had not put forward any evidence capable of calling into question the findings in that audit report’ (paragraph 101 of the judgment under appeal) and that the Commission had not breached the grant agreement (paragraph 102 of the judgment under appeal).

Error of law consisting in the failure to state reasons for the assertion that the draft report of audit 11-INFS-025 ‘already showed the existence of certain ineligible personnel costs as well as the infringement of certain contractual provisions, which was confirmed in the final version of the audit report’ (paragraph 99 of the judgment under appeal).

Error of law consisting in finding that there was an extension of the time limit laid down in paragraph 5 of point II. 22 of general conditions FP7 for the presentation of the final versions of audit reports 11-INFS-025 and 11-BA119-016 (paragraphs 93 and 95 of the judgment under appeal) and that the Commission did not breach the grant agreement (paragraph 97 of the judgment under appeal).

Even if claims directed against a decision of the Appeals Committee of the European Investment Bank have the effect of bringing before the Union judicature an appraisal report against which an administrative appeal has been lodged, that fact is not, in itself, a reason for the Union court to confine itself to considering the claims against the contested report, or to omit entirely to review the validity of the Appeals Committee’s decision, in so far as the Committee has full power of review authorising it to substitute its assessments for those contained in the report, a power on which the Civil Service Tribunal, on the other hand, cannot rely.
Même à considérer que les conclusions dirigées contre la décision du comité de recours de la Banque européenne d’investissement aient pour effet de saisir le juge de l’Union du rapport d’appréciation contre lequel un recours administratif a été introduit, cette circonstance ne justifie pas, en elle-même, que le juge de l’Union se limite à l’examen des conclusions dirigées contre le rapport litigieux, voire renonce complètement au contrôle du bien-fondé de la décision du comité de recours, dans la mesure où ce comité est doté d’un pouvoir de contrôle entier l’autorisant à substituer ses appréciations à celles figurant dans ledit rapport, pouvoir dont le Tribunal de la fonction publique ne saurait, pour sa part, se prévaloir.

Annul: (a) the decision of 18 December 2012 in so far as the Appeals Committee, under Article 22 of the Staff Regulations and Note to Staff No 715 HR/PO/2012-0103 of 29 March 2012, dismissed the appeal against the applicant’s staff report for 2011; (b) the part of that staff report containing the appraisal, in so far as the applicant’s performance is not summarised as ‘Exceptional’ or ‘Very good’ and in so far as no proposal is made to promote him to Function D, together with the part which sets his objectives for 2012; (c) all connected, consequent and prior measures, including the promotions referred to in the note from the Director of Human Resources ‘2011 staff appraisal exercise, award of promotions and titles’ of May 2012, given that, in view of the appraisal made by the applicant’s line managers and challenged in this action, the EIB failed to take him into consideration in the point ‘Promotions from Function E to D’;
annuler: a) la décision du 18 décembre 2012, en ce que le comité de recours, en vertu de l’article 22 du règlement du personnel de la BEI et de la note au personnel HR/PO/2012-0103 du 29 mars 2013, a rejeté le recours formé par le requérant contre son rapport d’évaluation pour 2011; b) le rapport d’évaluation pour 2011, en ce qu’il ne résume pas les appréciations par la note globale «performance exceptionnelle» ou «très bonne performance» et, enfin, en ce qu’il ne propose pas le requérant pour la promotion à la fonction D, ainsi qu’en ce qui concerne la fixation de ses objectifs pour l’année 2012; c) tous les actes connexes, consécutifs et préalables, et notamment les promotions décidées en vertu de la note du directeur des ressources humaines de mai 2012, intitulée «Exercice d’évaluation du personnel pour 2011, attribution des promotions et titres», étant donné que, eu égard au jugement exprimé par ses supérieurs, aujourd’hui attaqué, la BEI a omis de prendre le requérant en considération pour les «promotions de la fonction E à la fonction D»;

Even if, in the event of a challenge to a decision of the appeals committee established by the EIB in connection with the appraisal of its staff, the assessment report as well as the decision itself, automatically came before the Courts of the Union, that, taken alone, would not justify those Courts in limiting their consideration to the objections made to the report, and certainly not in failing entirely to exercise their power to review the merits of the Appeal Committee’s decision, insofar as the committee has a full power of review entitling it to substitute its own assessments for those contained in the report, a power which the Civil Service Tribunal does not enjoy.
Même à supposer que, en cas de contestation de la décision d’un comité de recours institué par la Banque européenne d’investissement en matière d’évaluation des membres du personnel, le juge de l’Union soit automatiquement saisi tant de cette décision que du rapport d’appréciation, cette circonstance ne justifie pas, en elle-même, que ce juge se limite à l’examen des conclusions dirigées contre ce rapport, voire renonce complètement au contrôle du bien-fondé de la décision du comité de recours, dans la mesure où ce comité est doté d’un pouvoir de contrôle entier l’autorisant à substituer ses appréciations à celles figurant dans ledit rapport, pouvoir dont le Tribunal de la fonction publique ne saurait, pour sa part, se prévaloir.
