The concept of ‘legally resident in the Union’ should cover both Union citizens and third country nationals who already benefit from rights conferred upon them by Union acts such as Council Regulation (EEC) No 1408/71 (10), Council Directive 2003/109/EC (11), Council Regulation (EC) No 859/2003 (12) and Directive 2004/38/EC of the European Parliament and of the Council (13).

2. Notes that fundamental rights remain a key subject of the petitions submitted, notably raising issues related to the rights of persons with disabilities, children’s rights, property rights, the right of free movement, including the portability of social security entitlements, without encountering any form of discrimination on any grounds, the protection of freedom of expression and privacy, freedom of association, and the right of access to documents and information; calls on Member States to apply correctly and respect those rights as set out in the Treaty and calls on the Commission to take the necessary measures to oblige non-compliant Member States to close the gap between national laws and the fundamental rights of EU citizens; considers that special attention should be given to the right to historical memory and the rights to truth, justice and redress for families which suffered under Franco’s dictatorship, as well as to the right of Spain’s abducted children to know the identity of their biological parents;
2. observe que les droits fondamentaux demeurent un sujet récurrent des pétitions présentées, notamment en ce qui concerne les droits des personnes handicapées, les droits des enfants, les droits de propriété, le droit à la liberté de circulation, y compris le transfert des prestations de sécurité sociale, sans discrimination aucune, la protection de la liberté d'expression et de la vie privée, la liberté d'association et le droit d'accès à des documents et à l'information; demande aux États membres d'appliquer correctement et de respecter ces droits, conformément au traité, et à la Commission de prendre les mesures qui s'imposent pour forcer les États membres qui ne respectent pas le traité à inscrire une fois pour toutes dans le droit national les droits fondamentaux dont tout citoyen de l'Union devrait disposer; estime qu'il y a lieu de porter une attention particulière au droit à la mémoire historique, aux droits des familles victimes du franquisme à la vérité, à la justice et à la réparation, et au droit des enfants volés en Espagne à connaître l'identité de leurs parents biologiques;

7. Requests the UN Secretary-General, to ensure that all relevant organisations and bodies of the UN systems, in particular the United Nations Children's Fund, the United Nations Population Fund, the World Health Organization, the United Nations Educational, Scientific and Cultural Organization, the United Nations Development Fund for Women, the United Nations Development Programme and the Office of the United Nations High Commissioner for Human Rights, individually and collectively, take into account the protection and promotion of the rights of girls against female genital mutilation in their country programmes, as appropriate, and in accordance with national priorities, in order to further strengthen their efforts in this regard;
7. demande au Secrétaire général des Nations unies de s'assurer que toutes les institutions et organes du système des Nations unies, en particulier le Fonds des Nations unies pour l'enfance, le Fonds des Nations unies pour la population, l'Organisation mondiale de la santé, l'Organisation des Nations unies pour l'éducation, la science et la culture, le Fonds de développement des Nations unies pour la femme, le Programme des Nations unies pour le développement et le Haut Commissariat aux droits de l'homme des Nations unies, intègrent individuellement et collectivement dans leurs programmes nationaux, de façon appropriée et conformément aux priorités nationales, la protection et la promotion des droits des filles de ne pas subir de mutilation génitale féminine, afin de redoubler d'efforts à ces égard;

support for the efforts of the competent international and regional actors relating to the promotion of the rights of the child, in particular the efforts of the UN Secretary General, the UN Security Council, the UN Treaty Bodies, in particular the Committee on the Rights of the Child and the UN Special Procedures mechanisms, the appropriate UN agencies, in particular the United Nations Children’s Fund (UNICEF), the Office of the United Nations High Commissioner for Human Rights (OHCHR), the International Labour Organization (ILO), the World Health Organization (WHO) and the United Nations Fund for Population Activities (UNFPA), and also regional mechanisms, in particular the Council of Europe, the OSCE, the European Network of Ombudspersons for Children and civil society organisations;

Reiterates its request to the Commission to encourage European Union Member States, and third countries with which there are ongoing negotiations for future accession, to sign up to, and ratify, all core United Nations and Council of Europe human rights conventions and the optional protocols thereto; draws the attention of European Union Member States to, in particular, the need to ratify the 1990 International Convention on the Protection of the Rights of All Migrant Workers and Members of their Families, which none of the Member States has ratified to date (17);

Stresses that the process leading up to adoption of the Strategy on the Rights of the Child should include a full and comprehensive consultation, involving national institutions for children's rights (such as ombudsmen for children's rights), UN agencies including UNICEF, the Committee on the Rights of the Child, civil society organisations and children in particular;

In order to focus more formally on the rights of children, I propose that 20 November each year should be designated European Day of Children's Rights (since 1996, France has designated this day National Day for Children's Rights).

During this period, for example, the EU welcomed a number of positive developments, such as the elections in Afghanistan and the level of female participation (18 September 2005), the adoption of the resolution establishing the Human Rights Council (16 March 2006), the abolition of the death penalty in the Philippines (26 June 2006) and the extension of the mandate of the Office of the United Nations High Commissioner for Human Rights in Colombia (26 June 2006).
