Notwithstanding any other provision in this Agreement, the Parties shall implement the provisions of Annex 4 in their decisions under their respective laws and regulations concerning ownership, investment and control.

4. Without prejudice to any other provisions of this Agreement, either Management Entity may run labelling programs with respect to product types not included in Annex C. Notwithstanding any other provisions of this Agreement, neither Party shall hinder the import, export, sale or distribution of any product because it bears the energy-efficiency marks of the Management Entity of the other Party.

However, while self- regulation might be an alternative method to implement certain provisions of this Directive, it cannot completely substitute the obligation of the national legislator.

4. Notwithstanding paragraphs 2 and 3, if the Commission is actively negotiating with the same third country on the basis of a country-specific mandate or on the basis of Council Decision 2004/../EC of. authorising the Commission to open negotiations with third countries on the replacement of certain provisions in existing bilateral agreements with a Community agreement , the Member State concerned may be authorised, in accordance with the procedure referred to in Article 7(2), to apply provisionally and/or conclude the agreement.

Nonobstant les dispositions des paragraphes 2 et 3, lorsque la Commission mène des négociations actives avec le même pays tiers, sur la base d'un mandat concernant spécifiquement le pays en question ou sur la base de la décision 2004/./CE du Conseil du .autorisant la Commission à ouvrir des négociations avec des pays tiers concernant le remplacement de certaines dispositions dans des accords bilatéraux conclus aux termes d'un accord communautaire , l'État membre concerné peut être autorisé, conformément à la procédure visée à l'article 7, paragraphe 2, à appliquer provisoirement l'accord et/ou à le conclure .
