When examining the major policy areas which affect the competitiveness of the European automotive industry, the ‘CARS 21 High Level Group’ agreed on a number of recommendations aimed at enhancing the industry’s global competitiveness and employment while sustaining further progress in safety and environmental performance, which was published in a report by the Commission in 2006 entitled ‘CARS 21: A Competitive Automotive Regulatory System for the 21st century’.

On 23 October 2007, the Commission Decision 2008/344/EC (1) (‘the decision’) was adopted in which the Commission concluded that State aid received by steel producer Technologie Buczek Group (‘TB Group’) was incompatible with the common market and ordered Poland to recover it from TB Group’s constituent entities, i.e. the mother company Technologie Buczek S.A (‘TB’) and its subsidiaries Huta Buczek sp. z o.o (‘HB’) and Buczek Automotive sp. z o.o (‘BA’) in proportion to the benefit actually obtained.

When examining the major policy areas which impact the competitiveness of the European automotive industry the CARS 21 High Level Group, set up by the Commission in 2005 to chart the way towards sustainable development of a competitive European automotive industry, agreed on a number of recommendations aiming at enhancing the industry’s global competitiveness and employment while sustaining further progress in safety and environmental performance.

[14] The “ Competitive Automotive Regulatory System for the 21 st century ” (CARS 21) initiative consists of a High Level Group which reviews existing legislation with a view to improving the regulatory framework affecting the competitiveness of the automotive industry.
