The Council of the European Union has decided that the persons that appear in the abovementioned Annexes should be included in the list of persons and entities subject to restrictive measures provided for in Decision 2014/119/CFSP and in Regulation (EU) No 208/2014 concerning restrictive measures directed against certain persons, entities and bodies in view of the situation in Ukraine.
Le Conseil de l’Union européenne a décidé que les personnes visées dans les annexes susmentionnées devaient être inscrites sur la liste des personnes et entités faisant l’objet des mesures restrictives prévues par la décision 2014/119/PESC et par le règlement (UE) no 208/2014 concernant des mesures restrictives à l’encontre de certaines personnes, de certaines entités et de certains organismes eu égard à la situation en Ukraine.

The following information is brought to the attention of the persons who appear in the Annex to Council Decision 2014/119/CFSP , as amended by Council Decision (CFSP) 2018/333 , and in Annex I to Council Regulation (EU) No 208/2014 concerning restrictive measures directed against certain persons, entities and bodies in view of the situation in Ukraine.
Les informations figurant ci-après sont portées à l’attention des personnes visées à l’annexe de la décision 2014/119/PESC du Conseil , modifiée par la décision (PESC) 2018/333 du Conseil , et à l’annexe I du règlement (UE) no 208/2014 du Conseil concernant des mesures restrictives à l’encontre de certaines personnes, de certaines entités et de certains organismes eu égard à la situation en Ukraine.

Provided that this complies with the right to a fair trial, the following situations do not constitute a deprivation of liberty within the meaning of this Directive: identifying the suspect or accused person; determining whether an investigation should be started; verifying the possession of weapons or other similar safety issues; carrying out investigative or evidence-gathering acts other than those specifically referred to in this Directive, such as body checks, physical examinations, blood, alcohol or similar tests, or the taking of photographs or fingerprints; bringing the suspect or accused person to appear before a competent authority, in accordance with national law.
Pour autant que le droit à un procès équitable soit respecté, les situations suivantes ne constituent pas une privation de liberté au sens de la présente directive: identifier le suspect ou la personne poursuivie; établir s'il y a lieu d'ouvrir une enquête; vérifier si la personne concernée détient des armes ou vérifier d'autres questions de sécurité similaires; prendre des mesures d'enquête ou de collecte de preuves autres que celles expressément visées dans la présente directive, telles qu'une fouille corporelle, un examen médical, un prélèvement de sang, un test d'alcoolémie ou autre test similaire, la prise de photographies ou le prélèvement des empreintes digitales; faire comparaître le suspect ou la personne poursuivie devant une autorité compétente conformément au droit national.

The right of an accused person to appear in person at the trial is based on the right to a fair trial provided for in Article 47 of the Charter and in Article 6 ECHR, as interpreted by the Court of Justice and by the European Court of Human Rights.
Le droit de la personne poursuivie d'assister à son procès est fondé sur le droit à un procès équitable consacré à l'article 47 de la charte et à l'article 6 de la CEDH, tels qu'ils sont interprétés par la Cour de justice et par la Cour européenne des droits de l'homme.

summon the suspected or accused persons to appear for the hearing in accordance with the detailed rules laid down in the law of the executing State and inform such persons about their rights under the law of the issuing State, in such a time as to allow them to exercise their rights of defence effectively;

The Court has also declared that the right of the accused person to appear in person at the trial is not absolute and that under certain conditions the accused person may, of his or her own free will, expressly or tacitly but unequivocally, waive that right.
La Cour a également déclaré que le droit de l’accusé de comparaître en personne au procès n’était pas absolu et que, dans certaines conditions, l’accusé peut y renoncer, de son plein gré, de manière expresse ou tacite, mais non équivoque.

Furthermore, the legislative act to be adopted should ensure protection for third parties acting in good faith who, for valuable consideration, have entered into a contract with the person who appears to be entitled to dispose of the property comprised in the estate on the basis of the certificate, thereby safeguarding the acquisition thereof, unless that person knows that the details given in the certificate are inaccurate or the competent authority has taken steps to revoke or amend the certificate.
En outre, l'acte législatif à adopter devrait assurer protection au tiers de bonne foi qui a contracté à titre onéreux avec la personne qui semble légitimée à disposer des biens composant la succession sur la base du certificat, en prévoyant donc la sauvegarde de l'acquisition que ledit tiers aura faite, à moins qu'il ne sache que les indications du certificat sont inexactes ou que l'autorité compétente a pris des mesures pour annuler ou modifier ce certificat.

The situation would be further simplified if this certificate could be regarded as sufficient title for the acquisition of the property to be entered in a public register, and in particular covered the purchase of property forming part of the estate by third parties who had acquired it in good faith from the person who appeared to be the heir or the person authorised to dispose of the estate on the basis of the certificate.
Enfin, on obtiendrait une simplification supplémentaire et non négligeable si ce certificat était considéré comme un titre approprié pour la transcription de l'acquisition par héritage dans les registres publics et s'il impliquait en particulier la sauvegarde de l'achat des biens héréditaires par un tiers de bonne foi à la personne qui, sur la base du certificat, paraissait être l'héritier ou le sujet pouvant légitimement disposer de l'héritage.
