TRADUCTIONS EN CONTEXTE

In order to achieve a balance between the need for better targeting, greater coherence and transparency on the one hand, and better promoting sustainable development and good governance through a unilateral trade preference scheme on the other hand, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of amendments to the Annexes to this Regulation and temporary withdrawals of tariff preferences due to failure to adhere to the principles of sustainable development and good governance, as well as procedural rules regarding the submission of applications for the tariff preferences granted under the special incentive arrangement for sustainable development and good governance, the conduct of a temporary withdrawal and safeguard investigations in order to establish uniform and detailed technical arrangements.
Afin de trouver un équilibre entre la nécessité d’améliorer le ciblage, la cohérence et la transparence, d’une part, et de mieux promouvoir le développement durable et la bonne gouvernance grâce à un schéma de préférences commerciales unilatérales, d’autre part, il convient de déléguer à la Commission le pouvoir d’adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne en ce qui concerne la modification des annexes du présent règlement, le retrait temporaire du bénéfice des préférences tarifaires en raison du non-respect des principes du développement durable et de la bonne gouvernance ainsi que les règles de procédure relatives à l’introduction des demandes de préférences tarifaires octroyées au titre du régime spécial d’encouragement en faveur du développement durable et de la bonne gouvernance et à la réalisation d’enquêtes en vue d’un retrait temporaire ou de l’institution de mesures de sauvegarde, de manière à définir des modalités techniques uniformes et détaillées.

Points out that, as regards the use of their powers, governments should clearly specify their role and should establish minimum requirements for environmental indicators, clear targets and timetables; any voluntary agreements should be used as a steering instrument only if the objectives have been set by the regulator in a transparent democratic process which ensures public participation and if they are accompanied by adequate monitoring and the possibility on the part of the State of imposing sanctions; finally, the IPP and any voluntary agreements should not replace, but should only supplement existing and future legislation;

Notwithstanding the requirements of Article 43(1)(b), the Member States may fix a weighting of 0 % for their own regional governments and local authorities if there is no difference in risk between claims on the latter and claims on their central governments because of the revenue-raising powers of the regional governments and local authorities and the existence of specific institutional arrangements the effect of which is to reduce the chances of default by the latter.
