The award of contracts concluded in the Member States by contracting entities as referred to in Directive 2004/17/EC of the European Parliament and of the Council of 31 March 2004 coordinating the procurement procedures of entities operating in the water, energy, transport and postal services sectors and by contracting authorities as referred to in Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts is subject to compliance with the principles of the Treaty and in particular the free movement of goods, the freedom of establishment and the freedom to provide services, and with the principles deriving therefrom, such as the principles of equal treatment, non-discrimination, mutual recognition, proportionality and transparency.

First of all, the Commission considers that the contract being awarded is to be qualified as a public works contract and not as a public works concession. As a consequence, the award of a public contract through a procedure, such as that of "project financing", aimed at the award of a works concession constitutes a violation of Directive 93/37/EEC. In addition, the Commission considers that the modification of the conditions for the award of the public contract in question after the publication of the tender notice, in particular with respect to the classification of the works to be realised, amounts to a breach of EC Treaty principles, and in particular the principles of transparency and non-discrimination, in so far as it has not allowed all operators, interested in and qualified for the works resulting from the modified project, to take part in the tendering procedure.

(28) Taking into account the further opening up of Community postal services to competition and the fact that such services are provided through a network by contracting authorities, public undertakings and other undertakings, contracts awarded by contracting entities providing postal services should be subject to the rules of this Directive, including those in Article 30, which, safeguarding the application of the principles referred to in recital 9, create a framework for sound commercial practice and allow greater flexibility than is offered by Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts(11).

The Court ruled that the contracting authority must award a contract to the tenderer whose tender is the most economically advantageous, but that it may nevertheless take environmental criteria (in the Finnish buses case, exhaust emissions and noise levels) into account when deciding which bids to take into consideration (i.e. the awardcriteria), provided that those criteria are expressly mentioned in the contract documents or the tender notice, are connected with the subject-matter of the contract, do not give the contracting authority an unrestricted freedom of choice, and comply with all the fundamental principles of Community law, in particular the principle of non-discrimination.
