1 By their appeal the companies Diy-Mar Insaat Sanayi ve Ticaret Ltd Sirketi and Musa Akar ask the Court to set aside the order of the Court of First Instance of the European Communities of 17 January 2007 in Case T‑129/06 Diy-Mar Insaat Sanayi ve Ticaret and Akar v Commission, not published in ECR, (‘the order under appeal’) dismissing as inadmissible their action which sought, first, annulment of the decision of the Commission MK/KS/DELTUR/(2005)/SecE/D/1614 of 23 December 2005 relating to the award of public works contracts for the construction of educational facilities in the provinces of Siirt and Diyarbakir (‘the contested decision’), and, secondly, suspension of the operation of the award procedure in question.
Par leur pourvoi, les sociétés Diy-Mar Insaat Sanayi ve Ticaret Ltd Sirketi et Musa Akar demandent l’annulation de l’ordonnance du Tribunal de première instance des Communautés européennes du 17 janvier 2007, Diy-Mar Insaat Sanayi ve Ticaret et Akar/Commission (T‑129/06, non publiée au Recueil, ci-après l’«ordonnance attaquée»), par laquelle celui-ci a rejeté comme irrecevable leur recours tendant, d’une part, à l’annulation de la décision MK/KS/DELTUR/(2005)/SecE/D/1614 de la Commission, du 23 décembre 2005, relative à la passation du marché public de travaux relatif à la construction d’établissements d’enseignement dans les provinces de Siirt et de Diyarbakir (ci-après la «décision litigieuse»), et, d’autre part, au sursis à l’exécution de la procédure de passation en cause.

(a) Without prejudice to Article 10(4), if the 80 % usage rate as defined in Article 8(2) cannot be achieved by an air carrier, the coordinator may decide to withdraw from that air carrier the series of slots in question for the remainder of the scheduling period and place them in the pool after having heard the air carrier concerned.
a) Sans préjudice de l'article 10, paragraphe 4, lorsqu'un transporteur aérien ne peut pas atteindre le taux d'utilisation de 80 % défini à l'article 8, paragraphe 2, le coordonnateur peut décider de retirer la série de créneaux horaires à ce transporteur aérien pour le reste de la période de planification horaire et de les placer dans le pool, après avoir entendu le transporteur aérien concerné.

(b) Without prejudice to Article 10(4), if after an allotted time corresponding to 20 % of the period of the series validity no slots of that series of slots have been used, the coordinator shall place the series of slots in question in the pool for the remainder of the scheduling period, after having heard the air carrier concerned".

The coordinator may decide to withdraw from that air carrier the series of slots in question for the remainder of the scheduling period and place them in the pool after having heard the air carrier concerned and after issuing a single warning.

Remarkably enough, none of these instruments provide for the person to be heard on the question as to where the sentence will be served.

It should be noted that, unlike Article 39 of the 1970 Council of Europe Convention, the 1991 Convention between the Member States of the European Communities does not provide that the sentenced person must be heard on the question as to where the sentence will be served.
