(2) If the ability of the designated body to govern its members in a manner that is in the public interest so that they provide professional and ethical representation and advice appears to be compromised, the body must provide to the Minister — within 10 business days after the day on which the body receives from the Minister a notice indicating the existence of such a situation and setting out any information or documents from among those referred to in paragraphs (1)(c) to (t) that are necessary to assist the Minister to evaluate whether the body governs its members in a manner that is in the public interest so that they provide professional and ethical representation and advice — the documents or information set out in the notice.

In proceedings pursuant to Chapter 4, representation by a lawyer or another legal professional shall not be mandatory unless, under the law of the Member State of the court or authority with which the application for a remedy is lodged, such representation is mandatory irrespective of the nationality or domicile of the parties.

Calls on the Member States to increase their efforts to prevent segregation of job markets by including in their structural labour market reforms instruments such as the European Social Fund (ESF) to combat professional segregation of women, as manifested both in the inadequate representation of women in leading positions and in the gender-segregated labour market, through effective measures against prejudices and stereotypes, as well as ‘glass ceiling’ barriers, exchange of good practice and benchmarking indicators between the Member States, and legislative measures including quotas to increase women’s representation in leading positions;

4. Firmly believes that a common minimum standard relating to procedural safeguards of suspects and defendants in criminal proceedings throughout the European Union will ensure that any individual present within the territory of a Member State (irrespective of his or her nationality and situation) is entitled to assistance from and representation by a lawyer and/or, where appropriate, a procurator (a professional practitioner who, in Spain, France and Portugal represents a party before the courts), from the moment when, as a suspect of complicity in crime, he or she is placed under arrest, taken into custody or charged with an offence by a public authority appropriately empowered to do so, and that such assistance or representation is provided free of charge if the suspect or defendant has insufficient means to pay for it and the provision of such services is required in the interests of justice; the technical defence of suspects and defendants shall be compulsory and indefeasible at every stage and level of criminal proceedings; considers that the right to legal assistance should embrace, at every stage and all tiers of the proceedings, the complete confidentiality of contacts between the defence lawyer and the suspect or defendant, the presence of the defence lawyer each time the suspect or defendant is questioned and his right to put questions both to the suspect or defendant and to any witnesses, and the right of the defence lawyer to submit evidence in exoneration;

Underlines the democratic deficit stemming from women’s under-representation in decision-making bodies and administrations in both the public and private sector, and in the political, economic, social and professional domain, at European, national, regional and local level; stresses that women’s continuing under-representation in the decision-making process poses a substantial obstacle to the democratic development of the EU’s regions and their social cohesion;
