In November, National Integrity Agency (ANI) reports[8] against ministers and senior officials did not lead to their resignations.[9] The new government reiterated its goal of tackling corruption, but amongst the new Ministers are two confirmed cases under criminal investigation for corruption.

An important test case is coming now with the nomination of a new Chief Prosecutor for the Directorate for Investigation of Organised Crime and Terrorism (DIICOT), following the resignation of the Chief Prosecutor in November.[6] The procedure includes a strong political element in terms of the role it gives to the Minister of Justice.[7] The Superior Council of the Magistracy (SCM) is working on an amendment to the law to change this, and to align appointment of prosecutors on the procedures used for judges, in line with the guidance of the European Commission for Democracy through Law of the Council of Europe (Venice Commission):[8] if this were to be pursued, the next step would be for the government to propose this to Parliament.

Supports Romania's efforts to root out the high level of corruption in state and society; strongly urges the Romanian Government to make use of the cooperation agreement it concluded with Europol on 13 May 2003 to render the fight against corruption more effective; takes the resignation of three ministers on 20 October 2003 to be a sign that this issue is taken seriously by the highest level of government; is, however, concerned that in general the services within the administration responsible for corruption appear to be too passive in investigating such cases; acknowledges that the legal framework to fight corruption is in place and calls on the Romanian authorities to focus attention on the enforcement of the existing legislation; in this context urges the government to further increase the staff at the National Anti-Corruption Prosecutor's Office and to give permanent status to all of the prosecutors rather than having them seconded by other government bodies; asks the government to provide further training for all the staff as well as to strengthen the office's operational independence, in particular by eliminating the responsibility of political appointees and politicians to decide on the launching of anti-corruption investigations; notes that first and foremost there must be the political will to eradicate corruption, for only this will lead to a change in attitudes;

Ron Ghitter: Honourable senators, considering the fact that Mr. Rock was the minister who bungled the gun control bill, considering that he was the minister who deceived the House of Commons and this chamber with respect to the Pearson airport deal, considering that Mr. Rock was the minister whose actions were totally out of order with respect to the Airbus situation and, now, considering the way he has totally bungled the hepatitis C matter, would the Leader of the Government in the Senate not agree that it is time for the minister to resign and go to the back-benches?

Rock était le ministre qui a bousillé le projet de loi sur le contrôle des armes à feu, qu'il était le ministre qui a trompé la Chambre des communes et le Sénat au sujet du règlement de l'affaire de l'aéroport Pearson, qu'il a posé, à titre de ministre, des gestes tout à fait inappropriés dans l'affaire Airbus, et considérant qu'il a complètement gâché le dossier de l'hépatite C, le leader du gouvernement au Sénat convient-il que le moment est venu pour le ministre de démissionner et de redevenir simple député d'arrière-ban?
