The Commission shall be empowered to adopt delegated acts, in accordance with Article 20, amending the list of deep-sea species in Annex 1, including the designation of most vulnerable species, to incorporate new scientific information from Member States, from the scientific advisory body and from other relevant sources of information, including the IUCN Red List Assessments. When adopting such delegated acts, the Commission shall, in particular, take account of the IUCN Red List Criteria, the rarity of the species, its vulnerability to exploitation and whether the scientific advisory body has recommended a zero by-catch. Updating could also be effected by the deletion from Annex IIIa of ingredients for which it has been scientifically established that it is not possible for them to cause adverse reactions. In this regard, on or before 1 January 2004 the Commission shall, following an opinion of the European Food Safety Authority, adopt a provisional list of products which although derived from a product listed in Annex IIIa should, by virtue of their composition and usage and in the light of the available evidence, be considered not to be allergenic and which are consequently not included in Annex IIIa.
