21. Warns the Serbian authorities that the organisation of local elections in Kosovo would be contrary to international law, with particular reference to UN Security Council Resolution 1244, and would undermine regional stability and the ongoing bilateral dialogue with Kosovo; points out that the modalities for potential participation in Serbia's forthcoming general elections by Kosovars holding Serbian citizenship who are resident in Kosovo should be agreed with the Kosovar authorities in cooperation with the UN Interim Administration Mission in Kosovo (UNMIK) and the OSCE;

Calls on the Serbian authorities to adopt a constructive attitude towards the forthcoming general elections in Kosovo; points out that stable and multiethnic institutions in Kosovo are in the interest of both Serbia and the other neighbouring countries and considers, in this regard, the participation of Kosovo Serbs in the electoral process an indispensable element aimed at preventing the Kosovo Serbian community from being marginalised;

Takes note of the briefing presented by the Chief Prosecutor of the ICTY, Carla Del Ponte, to the General Affairs and External Relations Council of the EU, meeting in Luxembourg on 15 October 2007; calls on Serbia to resolve the still open issues concerning full cooperation with the ICTY in connection with the forthcoming visit of Ms Del Ponte to Belgrade; calls on the Commission, once those issues have been resolved, to initial the SAA without further delay;

The Commission will step up its efforts to ensure full consistency of the Community's policies in the area of services of general interest and will look at full coherence of its sectoral policies with regard to its general approach during the forthcoming reviews of the sectors concerned [26].
