TRADUCTIONS EN CONTEXTE

With a view to meeting that need, the recruitment by the EPPO of temporary and contract agents already working in the institutions, bodies, offices or agencies of the Union should be facilitated by guaranteeing those staff members continuity of their contractual rights if they are recruited by the EPPO in its set-up phase until 1 year after the EPPO becomes operational in accordance with the decision in Article 120(2).
Pour répondre à ce besoin, il convient de faciliter le recrutement par le Parquet européen d’agents temporaires ou contractuels qui travaillent déjà au sein des institutions, organes ou organismes de l’Union, en garantissant à ces agents le maintien de leurs droits contractuels s’ils sont recrutés par le Parquet européen au cours de sa phase de mise en place jusqu’à un an après que le Parquet européen sera devenu opérationnel conformément à la décision mentionnée à l’article 120, paragraphe 2.

1. Temporary agents employed under point (a) of Article 2 of the Conditions of Employment in the institutions, bodies, offices or agencies of the Union who are engaged by the EPPO with a contract concluded before and no later than 1 year after the EPPO becomes operational in accordance with the decision mentioned in Article 120(2) shall be offered contracts under point (f) of Article 2 of the Conditions of Employment whereas all other conditions of the contract shall remain unchanged, without prejudice to the need to respect the obligations stemming from the Conditions of Employment.

Les agents temporaires qui sont employés au sein des institutions, organes ou organismes de l’Union au titre de l’article 2, point a), du régime applicable aux autres agents et qui sont engagés par le Parquet européen dans le cadre d’un contrat conclu avant que le Parquet européen soit devenu opérationnel conformément à la décision visée à l’article 120, paragraphe 2, et au plus tard un an après, se voient offrir des contrats au titre de l’article 2, point f), du régime applicable aux autres agents, toutes les autres conditions du contrat demeurant inchangées, sans préjudice de la nécessité de respecter les obligations découlant du régime applicable aux autres agents.

3. Temporary agents employed under point (f) of Article 2 of the Conditions of Employment and contract agents employed under Article 3a of the Conditions of Employment in the institutions, bodies, offices or agencies of the Union who are engaged by the EPPO with a contract concluded before and no later than 1 year after the EPPO becomes operational in accordance with the decision mentioned in Article 120(2) shall be offered contracts under the same conditions.
3. Les agents temporaires qui sont employés au titre de l’article 2, point f), du régime applicable aux autres agents et les agents contractuels qui sont employés au titre de l’article 3 bis du régime applicable aux autres agents au sein des organes et organismes de l’Union et qui sont engagés par le Parquet européen dans le cadre d’un contrat conclu avant que le Parquet européen soit devenu opérationnel conformément à la décision visée à l’article 120, paragraphe 2, et au plus tard un an après, se voient offrir des contrats dans les mêmes conditions.

The inclusion in a temporary staff contract of a termination clause making the maintenance of the employment relationship depend on the name of the member of the temporary staff concerned being included on the reserve list of an open competition organised by the European Personnel Selection Office is of such a kind as to adversely affect that servant, in the light, at least, of the uncertainty as to whether he will appear on the reserve list drawn up following that competition.
L’insertion dans un contrat d’agent temporaire d’une clause de résiliation faisant dépendre le maintien de la relation de travail de l’inscription du nom de l’agent temporaire concerné sur la liste de réserve d’un concours général organisé par l’Office européen de sélection du personnel est de nature à faire grief à cet agent compte tenu, à tout le moins, de l’incertitude pour lui de figurer sur la liste de réserve établie à l’issue dudit concours.

Notes the efforts made to implement the authorised establishment plan of 130 posts in 2008; welcomes the recruitment of 54 additional staff (temporary agents, contract agents and seconded national experts), resulting in 101 occupied posts by the end of 2008, which will help to ensure the operability of the Centre and enable it to achieve the tasks assigned to it; regrets the fact that 16 recruitment procedures needed to be re-advertised; supports the Centre's measures to improve the situation; welcomes the Centre's revision of its internal organisation;
10. prend acte des efforts consentis afin de pourvoir les 130 postes inscrits à l'organigramme pour 2008; se félicite du recrutement de 54 agents supplémentaires (agents temporaires, agents contractuels et experts nationaux détachés), ce qui porte à 101 le nombre de postes occupés à la fin de l'exercice 2008 et contribue ainsi à permettre au Centre de fonctionner et de mener à bien les tâches qui lui ont été attribuées; déplore le fait que, pour 16 procédures de recrutement, un nouvel avis de vacance ait dû être publié; appuie les mesures adoptées par le Centre en vue de remédier à ce problème; se félicite de ce que le Centre ait revu son organisation interne;
